Commission Decision
The TTC Board:
1. Approved the Confidential Recommendations as set out in the Confidential Attachment 2; and
2. Subject to recommendation 3 below, authorized that the information provided in Confidential Attachment 2 is to remain confidential in its entirety as it contains advice which is subject to client-solicitor privilege.
3. Authorized that the recommendations provided in Confidential Attachment 2 are to remain confidential until the earlier of, (a) a full and final settlement, or (b) a determination by General Counsel that a full and final settlement is not possible.

The General Counsel has adopted the practice of providing the Board with periodic updates on large litigation matters (non-personal injury and accident benefits) where the potential financial impact, both favourable and unfavourable, is $500,000.00 or greater.
