The Toronto and East York Community Council:

1. Granted the application for a fence exemption to the property owner of 328 Glenholme Avenue, thereby allowing the existing fence to be maintained as constructed.

2. Directed that at such time when a replacement of the fence is required that such installation will comply with Municipal Code Chapter 447, Fences or its successor by-law.

Summary

The Applicant for 328 Glenholme Avenue has requested Toronto and East York Community Council to exempt their property from the following by-law requirements:

City of Toronto Municipal Code Chapter 447 Section 1.2.B(1) fence in rear yard not to exceed 2.0 metres in height.

The Applicant for 328 Glenholme Avenue is requesting an exemption for their:

- Existing wooden fence in rear yard to remain

- Rear fence – Eastern lot line 1st fence panel is a height of 2.72 metres

- Rear fence – Eastern lot line 2nd fence panel is a height of 2.14 metres

- Rear fence – Eastern lot line 3rd and 4th fence panel are a height of 2.04 metres

- Rear fence – Eastern lot line 5th fence panel is a height of 2.03 metres

- Rear fence – Southern lot line fence panels are a height of 2.03 metres

- Rear fence – Western lot line fence panels is a height of 2.03 metres

Municipal Licensing and Standards Division has inspected the subject property and issued a notice of violation of City of Toronto Municipal Code Chapter 447 Section 1.2.B(1) fence in rear yard not to exceed 2.0 metres in height.

1. Toronto and East York Community Council:

a. grant the application for a fence exemption to the property owner of 328 Glenholme Avenue, thereby allowing the existing fence to be maintained as constructed; and

b. direct that at such time when a replacement of the fence is required that such installation will comply with Municipal Code Chapter 447, Fences or its successor by-law.
