Community Council Recommendations

The Scarborough Community Council recommends that: 

 

1. City Council direct the City Solicitor, together with appropriate City staff, to attend the Ontario Land Tribunal hearing to oppose the Zoning By-law Amendment application for the property at 3718 and 3730 Kingston Road in its current form.
 

2. City Council authorize the City Solicitor to retain external consultants to provide expert opinion evidence in opposition to the application and in support of City Council's position at the Ontario Land Tribunal to oppose the application to amend Zoning By-law to permit the proposed development at 3718 and 3730 Kingston Road in its current form.
 

3. City Council authorize the City Solicitor and City Staff to take any necessary steps to implement City Council's decision, including requesting any conditions of approval that would be in the City's interest, in the event the Ontario Land Tribunal allows the appeal, in whole or in part.

Summary

This report provides updates on item SC31.2 - 3718 and 3730 Kingston Road – Zoning By-law Amendment. On June 3, 2026 the applicant appealed the application to the Ontario Land Tribunal (the "OLT") citing the failure of City Council to make a decision within the time frame legislated by the Planning Act.

 

Through the Decision Report submitted to Scarborough Community Council, staff recommended approval of the 24 storey building containing 419 residential units and 672 square metres of non-residential gross floor area. Scarborough Community Council considered this item and recommended that City Council refuse the application. City Council subsequently considered the item on May 21, 2026, and referred it to the July 9, 2026 Scarborough Community Council meeting to allow the proponent to finalize their proposal in conjunction with a community meeting paid for at their expense. As the applications have been appealed, the requests made of the applicant through the referral have not been undertaken.

 

The appealed application remains in the form previously recommended for approval by staff. This report recommends that City Council direct the City Solicitor and other staff as appropriate, attend the OLT to support the application in its current form.

Summary

City Council on May 20 and 21, 2026, referred Item SC31.2 to the July 9, 2026, meeting of the Scarborough Community Council to allow the proponent to finalize their proposal in conjunction with a community meeting paid for at their expense. 

 

This report recommends approval of the application to amend the Zoning By-law to permit the development of a 24-storey mixed-use building with a 7-storey podium at 3718 and 3730 Kingston Road. A total gross floor area of 30,905 square metres is proposed, consisting of 30,233 square metres of residential gross floor area (419 residential units) and 672 square metres of non-residential gross floor area resulting in a floor space index (FSI) of 5.25 times the area of the lot.

 

The proposed development is consistent with the Provincial Planning Statement 2024 (PPS 2024) and conforms to the City's Official Plan. The proposal will intensify an underutilized site along an Avenue that is well served by both surface transit and emerging higher order transit networks through the Eglinton East Light Rail (EELRT).

 

This report reviews and recommends approval of the application to amend the Zoning By-law.
