Speaker Nunziata advised Council that the provisions of Chapter 27, Council Procedures, require that Motion MM42.29 be referred to the Planning and Housing Committee. A two-thirds vote of the Council Members present is required to waive referral.
That City Council amend Recommendation 1 by deleting the words "the removal of the required cash contribution for the increase in density, in an effort to preserve the construction of a fully built-out daycare and recognize the over-dedication of parkland" and replacing them with the words "to introduce an election by City Council to require the Owner to provide two of the required facilities services and matters secured as Section 37 benefits"
so that it now reads as follows:
1. City Council direct the Executive Director, Development Review to bring forward a City-initiated amendment to By-laws 1285-2022 (OLT) and 1286-2022 (OLT) to amend the terms of the Section 37 benefits, specifically the removal of the required cash contribution for the increase in density, in an effort to preserve the construction of a fully built-out daycare and recognize the over-dedication of parkland to introduce an election by City Council to require the Owner to provide two of the required facilities services and matters secured as Section 37 benefits.
That:
1. City Council elect that, in the event that the By-law Amendments are adopted, the Owner provide:
a. the Parkland Over dedication; and
b. the conveyance and construction of the childcare facility in accordance with the terms in the By-law and Section 37 Agreement.
