Origin
Summary
This staff report concerns a matter for which the Etobicoke York Community Council has delegated authority from City Council to make a final decision.
This report responds to an application submitted by the owner of 122 Jeffcoat Drive requesting a site-specific Fence Exemption under Toronto Municipal Code, Chapter 447, Section 447-1.2C. (1) – Fences.
The owner is seeking permission to maintain an existing solid wood fence located within 2.4 metres of a driveway. Chapter 447 requires fences within this area to be of open construction to preserve sightlines to the adjacent boulevard and roadway.
Following a public complaint, Municipal Licensing and Standards staff inspected the property and determined that the fence does not comply with the by-law and creates a sightline obstruction. A Notice of Violation was issued to the property owner.
The existing fence does not meet the open-construction requirements of the by-law and impairs visibility at the driveway access.
