City Council Decision
City Council on June 24 and 25, 2026, adopted the following:
1. City Council adopt the confidential instructions to staff in Confidential Attachment 1 to the report (June 10, 2026) from the City Solicitor.
2. City Council authorize the public release of the confidential instructions to staff in Confidential Attachment 1 and Confidential Appendices A, B, and C to the report (June 10, 2026) from the City Solicitor.
3. City Council direct that the balance of Confidential Attachment 1 to the report (June 10, 2026) from the City Solicitor remain confidential at the discretion of the City Solicitor, as it contains advice that is subject to solicitor-client privilege.
The confidential instructions to staff in Confidential Attachment 1 to the report (June 10, 2026) from the City Solicitor were adopted by City Council and are now public as follows:
1. City Council accept the without prejudice offer to settle dated June 9, 2026, set out in Confidential Appendix A to the report (June 10, 2026) from the City Solicitor, the settlement plans as set out in Confidential Appendix B and Confidential Appendix C to the report (June 10, 2026) from the City Solicitor, and direct the City Solicitor to attend at the Ontario Land Tribunal in support of the settlement, subject to the conditions set out below:
a. the final form and content of the Zoning By-law Amendment is satisfactory to the Executive Director, Development Review and the City Solicitor;
b. the owner has submitted a final Site Grading Plan, signed and stamped by a qualified professional engineer, to the satisfaction of the Toronto and Region Conservation Authority and the Executive Director, Development Review;
c. the owner has submitted a final floodplain/flood hazard memorandum, signed and stamped by a qualified professional engineer, to the satisfaction of the Toronto and Region Conservation Authority;
d. the owner has submitted a revised Functional Servicing and Stormwater Management Report to the satisfaction of the Executive Director, Engineering Review;
e. the owner has secured the design and provided financial securities in respect of any upgrades or required improvements to the existing municipal infrastructure identified in the accepted Engineering Reports, to support the development, all to the satisfaction of the Director, Engineering Review, and the General Manager, Toronto Water, should it be determined that improvements or upgrades are required to support the development, according to the Engineering Reports accepted by the Director, Engineering Review, and the General Manager, Toronto Water;
f. the owner has entered into a Municipal Infrastructure Agreement to financially secure the construction of any improvements to the municipal infrastructure in connection with the Functional Servicing Report accepted by the Executive Director, Engineering Review, should it be determined that improvements to such infrastructure are required;
g. the owner has submitted a revised Transportation Impact Study, together with satisfactory vehicle manoeuvring diagrams, demonstrating that passenger vehicles, a Large Single Unit design vehicle, and City of Toronto front loading refuse collection vehicles can be safely and adequately accommodated on-site and at proposed access points, to the satisfaction of the Executive Director, Development Review;
h. the owner has satisfactorily addressed matters from Tree Protection and Plan Review, Urban Forestry Memorandum dated December 11, 2025, or any outstanding issues raised by Urban Forestry, arising from the ongoing technical review (including provision of acceptable reports and studies), as they relate to the Zoning By-law Amendment application, to the satisfaction of the Executive Director, Environment, Climate and Forestry and the owner;
i. City Council approve that, in accordance with Section 42 of the Planning Act, that prior to the issuance of the first above-grade building permit for the development, the owner shall convey an off-site parkland dedication with a minimum area of 791 square metres, the parkland dedication shall have a minimum frontage on Midland Avenue of approximately 29.6 metres and shall be located in the northwest corner of the site;
j. City Council approve the acceptance of the off-site parkland dedication, subject to the owner transferring the parkland to the City free and clear, above and below grade, of all easements, encumbrances, and encroachments, and in an acceptable environmental condition, to the satisfaction of the Executive Director, Development Review;
k. City Council approve a development charge credit against the Parks and Recreation component of the Development Charges for the design and construction by the owner of the Above Base Park Improvements to the satisfaction of the General Manager, Parks and Recreation; the development charge credit shall be in an amount that is the lesser of the cost to the owner of designing and constructing the Above Base Park Improvements, as approved by the General Manager, Parks and Recreation, and the Parks and Recreation component of development charges payable for the development in accordance with the City's Development Charges By-law, as may be amended from time to time;
l. the owner has submitted a revised Landscape Plan, to the satisfaction of the Executive Director, Development Review; and
m. the owner has submitted a revised Pedestrian Level Wind Study, including the identification of any required mitigation measures to be secured in the Zoning By-law Amendment, to the satisfaction of the Executive Director, Development Review.
2. City Council authorize the City Solicitor to take all necessary and reasonable actions to implement City Council's decision.

The balance of Confidential Attachment 1 to the report (June 10, 2026) from the City Solicitor remains confidential at this time in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice that is subject to solicitor-client privilege. The balance of Confidential Attachment 1 to the report (June 10, 2026) from the City Solicitor will be made public at the discretion of the City Solicitor.
