City Council Decision

City Council on April 22 and 23, 2026, adopted the following:

     

1. City Council adopt the confidential instructions to staff in Confidential Attachment 1 to the report (April 10, 2026) from the City Solicitor.

 

2. City Council authorize the public release of the instructions to staff in Confidential Attachment 1 and Confidential Appendices A and B to the report (April 10, 2026) from the City Solicitor.

3. City Council direct that the balance of Confidential Attachment 1 to the report (April 10, 2026) from the City Solicitor remain confidential at the discretion of the City Solicitor, as it contains advice that is subject to solicitor-client privilege.

 

4. City Council request the applicant, in consultation with the Ward Councillor and the Executive Director, Development Review, to establish a Neighbourhood Liaison Committee, including the Deer Park Residents Group and other key community stakeholders, and consult the Neighbourhood Liaison Committee on the Site Plan Application and the Construction Management Plan.


5. City Council request the Executive Director, Development Review, in consultation with the local Ward Councillor and the City Solicitor, to work with the applicant to secure an in-kind community benefit contribution to support local community priorities including new parks, community space, or affordable housing.


6. City Council request the Executive Director, Development Review to request the applicant to consider an alternative built form with a taller podium and lower tower height, without removing any gross floor area.


7. City Council request the Executive Director, Development Review to request the applicant to convert the ground-floor amenity space to townhomes, to ensure the building design is more aligned with the existing neighbourhood feel along Lawton Boulevard.


8. City Council request the Executive Director, Development Review to work with the applicant to deliver an expanded Carolyn Bennett Parkette.


9. City Council request the Executive Director, Development Review and the General Manager, Transportation Services to request the applicant to conduct additional traffic impact analysis.
 

10. City Council request the Executive Director, Development Review and the General Manager, Transportation Services to consider options to implement additional local traffic calming measures to mitigate traffic impacts.

 

The confidential instructions to staff in Confidential Attachment 1 to the report (April 10, 2026) from the City Solicitor were adopted by City Council and are now public as follows:

 

1. City Council accept the without prejudice offer to settle dated April 9, 2026, as set out in Confidential Appendix A to the report (April 10, 2026) from the City Solicitor and the settlement plans, as set out in Confidential Appendix B to the report (April 10, 2026) from the City Solicitor and direct the City Solicitor to attend at the Ontario Land Tribunal in support of the settlement, subject to the conditions set out below:

 

a. the final form and content of the draft Official Plan Amendment and Zoning By-law Amendments are to the satisfaction of the City Solicitor and the Executive Director, Development Review;

 

b. the applicant has provided a revised Pedestrian Level Wind Study, with the identification of any required mitigation measures to be secured in the Zoning By-law Amendment and through the Site Plan Control process, all to the satisfaction of the Executive Director, Development Review;

 

c. the applicant has provided a revised Arborist and Tree Protection Plan, to the satisfaction of Urban Forestry and the Executive Director, Development Review;

 

d. the applicant shall make reasonable commercial efforts to identify, in consultation with the Executive Director, Development Review, a suitable off-site parkland dedication as a substitution for an on-site parkland dedication that complies with Policy 3.2.3.8 of the Toronto Official Plan; the off-site conveyance would be subject to the approval of the Executive Director, Development Review and would be subject to conditions for conveyance of parkland prior to the issuance of the First Above Grade Building Permit; in the event the Applicant is unable to provide an off-site parkland dedication to the City, the Applicant will be required to satisfy the parkland dedication requirement through a cash-in-lieu of parkland payment prior to the issuance of first above grade building permit in accordance with Chapter 415 Article III of the Municipal Code;

 

e. the applicant has submitted a revised Functional Servicing and Stormwater Management Report to the satisfaction of the Chief Engineer and Executive Director, Engineering and Construction Services; and

 

f. the applicant has entered into a Municipal Infrastructure Agreement to financially secure the construction of any improvements to the municipal infrastructure in connection with the Functional Servicing Report accepted by the Chief Engineer and Executive Director, Engineering and Construction Services, should it be determined that improvements to such infrastructure are required.

 

2. City Council authorize the City Solicitor to take all necessary and reasonable actions to implement City Council's decision.

The balance of Confidential Attachment 1 to the report (April 10, 2026) from the City Solicitor remains confidential at this time in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice that is subject to solicitor-client privilege. The balance of Confidential Attachment 1 to the report (April 10, 2026) from the City Solicitor will be made public at the discretion of the City Solicitor.
