That:

1. City Council amend Toronto and East York Community Council Recommendation 6 by:

a. deleting the words "to report on" after words "Transportation Services" and replacing with "to review"; and

b. adding the words "and report back by the first quarter of 2026 to the Toronto and East York Community Council with recommendations" after the words "resulting from this application".

so that it now reads as follows:

6. City Council request the Executive Director, Development Review and the General Manager, Transportation Services to report on to review options to mitigate traffic impacts on Foxbar Road resulting from this application, and report back by the first quarter of 2026 to the Toronto and East York Community Council with recommendations.

2. City Council delete Toronto and East York Community Council Recommendation 8 and adopt instead the following:

8. City Council request the Applicant establish a Neighbourhood Liaison Committee, as part of the Sites Plan, including the Deer Park Residents Group, Foxbar Neighbourhood Association, South Hill Residents Association, Brown Public School representatives, and Bradgate Arms Retirement Home, in consultation with the Ward Councillor, the General Manager, Transportation Services and the Executive Director, Development Review, and be required to consult the committee developing a Construction Management Plan for the project; as a part of the construction management plan, request the following key priorities be addressed:

a. weekly cleaning of the streets, sidewalks, and adjacent properties, including windows as necessary, and watering to reduce dust on Foxbar Road;

b. tarpaulins over trucks entering or exiting the property to contain dust and debris;

c. extensive and continual treatment against vermin, particularly rats, that will be displaced by excavation both at the site and at individual residences and buildings;

d. the installation of effective sound mitigation measures and screening adjacent to the Bradgate Arms;

e. active minimizing of disruptions and adequate notice to residents of any major neighbourhood disruptions;

f. effective approaches to limit the occupancy of the right-of-way for construction staging, to minimize impacts to traffic;

g. construction and demolition entrances to proceed off of Avenue Road or St. Clair West if possible;

h. installation of a crossing guard at Avenue-St. Clair during school hour; and

i. any other items the committee deem appropriate.

3. City Council delete Toronto and East York Community Council Recommendation 9 and adopt instead the following:

9. City Council request the Executive Director, Development Review to work with the applicant and Ward Councillor to consult with the Neighbourhood Liaison Committee at the site plan stage on issues, including but not limited to:

a. the implementation of local traffic mitigation measures based on Recommendation 1 above;

b. implement wind mitigation measures specifically focused on Bradgate arms, with sensitivity to the high number of seniors;

c. increasing and enhancing enhance tree planting and greenery; and

d. the design of any proposed public art.

That:

1. Toronto and East York Community Council delete Recommendation 4

Recommendation to be deleted:

4. City Council request the Mayor to consider allocating any Community Benefits Charges funds collected from the development at 135 St. Clair Avenue West to improvements for Brown Community Centre, located at 454 Avenue Road, through the annual budget process immediately following the payment of the funds to the City.

and adopt instead the following new recommendation:

1. City Council request the Mayor, as a part of the 2025-2026 Budget process, to allocate the Community Benefits Charges contribution from the development at 135 St. Clair West towards the Brown Community Centre and/or Brown Junior Public School located at 454 Avenue Road, in consultation with the Brown School Principal and Parent Council Chair, and the Toronto Lands Corporation, for the following priorities:

a. gymnasium facility upgrades;

b. the installation of air conditioning;

c. the pool facilities;

d. schoolyard/play area improvements; and

e. any other priorities determined through consultation.

2. Toronto and East York Community Council adopt the following new recommendations:

1. City Council request the Executive Director, Development Review and the General Manager, Transportation Services to report on options to mitigate traffic impacts on Foxbar Road resulting from this application.

2.  City Council request the General Manager, Transportation Services to review and report back on the feasibility of amending Schedule B of the City of Toronto Municipal Code, Chapter 925, Permit Parking, to exclude the development located at 135 St. Clair West from permit parking.

3.  City Council request the Applicant establish a Neighbourhood Liaison Committee including the Deer Park Residents Group, Foxbar Neighbourhood Association, South Hill Residents Association, Brown Public School representatives, and Bradgate Arms Retirement Home, in consultation with the Ward Councillor, the General Manager, Transportation Services and the Executive Director, Development Review, and to consult the committee developing a Construction Management Plan for the project; as a part of the construction management plan, request the following key priorities be addressed:

d. the design of any proposed public art.
