GG19.27 - Award of Doc4863856516 to GFL Environmental Inc., for Containerized Multi-Residential Collection of Waste Materials for Solid Waste Management Services

City Council Decision
City Council on April 23 and 24, 2025, adopted the following:
1. City Council in accordance with Section 195-8.5 of Toronto Municipal Code Chapter 195, Procurement, authorize the General Manager, Solid Waste Management Services to award and enter into an agreement with GFL Environmental Inc., being the lowest Supplier meeting specifications for Request for Quotations Doc4863856516 for containerized collection, transportation and off-loading of materials in the City of Toronto commencing on June 27, 2026 to June 24, 2033, for a total contract value of $136,873,865 net of all applicable taxes and charges ($139,282,845 net of Harmonized Sales Tax recoveries) from June 27, 2026 to June 24, 2033, all in accordance with the terms and conditions as set out in the Request for Quotation and any other terms and conditions satisfactory to the General Manager, Solid Waste Management Services, and in a form satisfactory to the City Solicitor.
2. City Council direct the General Manager, Solid Waste Management Services to include in all solid waste contract Requests for Quotation and/or Requests for Proposal going forward, a condition that the bidder certify that they have provided a list of all environmental violations, spills, and/or infractions, including any and all convictions, and that this be incorporated into the evaluation process going forward.
3. City Council direct the General Manager, Solid Waste Management Services, in collaboration with Executive Director, Environment, Climate and Forestry, to report to the Infrastructure and Environment Committee in the first quarter of 2026 on:
a. the feasibility of a Request for Proposal or any future procurements of waste collection services; and
b. a procurement strategy that considers/incorporates/evaluates:
1. supplier performance and sustainability practices in alignment with TransformTO and the City’s sustainability objectives, including reaching Net Zero by 2040; and
2. how evaluation criteria can be included in the solicitation regarding sustainable practices and regulatory compliance of proponents; and
c. the feasibility of performing an environmental audit on current and future waste management contracts.
4. City Council direct that Confidential Attachment 1 to the supplementary report (April 22, 2025) from the Deputy City Manager, Infrastructure and Development Services and the Chief Financial Officer and Treasurer remain confidential in its entirety, as it pertains to litigation or potential litigation.

April 23, 2025, at 5:24 p.m. - Speaker Nunziata advised that City Council had completed its closed session consideration of Item GG20.27, headed “Award of Doc4863856516 to GFL Environmental Inc., for Containerized Multi-Residential Collection of Waste Materials for Solid Waste Management Services”. No motions were adopted during the closed session. City Council would now proceed with the public debate on the Item.
That:
1. City Council direct the General Manager, Solid Waste Management Services to include in all solid waste contract RFQs and/or RFPs going forward, a condition that the bidder certify that they have provided a list of all environmental violations, spills, and/or infractions, including any and all convictions, and that this be incorporated into the evaluation process going forward.
That:
1. City Council direct the General Manager, Solid Waste Management Services, in collaboration with Executive Director, Environment, Climate and Forestry, to report to the Infrastructure and Environment Committee in the first quarter of 2026:

1. City Council direct that the confidential information contained in Confidential Attachment 1 remain confidential in its entirety, as it pertains to litigation or potential litigation.
That in accordance with the provisions of Chapter 27, Council Procedures, City Council reconsider Item GG19.27.
That City Council amend Motion 1 by Councillor Jamaal Myers by adding the word "collection" before the word "contract" so it now reads as follows:
1. City Council direct the General Manager, Solid Waste Management Services to include in all solid waste collection contract RFQs and/or RFPs going forward, a condition that the bidder certify that they have provided a list of all environmental violations, spills, and/or infractions, including any and all convictions, and that this be incorporated into the evaluation process going forward.

The purpose of this report is to advise on the results of the Request for Quotation Doc4863856516 for Containerized Waste Collection Services issued for the collection, transportation and off-loading services of containerized multi-residential garbage, organic materials, bulky items and durable goods from multi-residential units, non-residential locations, schools, Divisions, Agencies, and Corporations and related facilities as well as the collection, transportation and off-loading of recyclable materials from non-eligible customer types, in the collection area in the City of Toronto, and to request the authority to enter into an agreement with GFL Environmental Inc., being the lowest Supplier meeting specifications, in the amount of $136,873,865 net of all applicable taxes and charges ($139,282,845 net of Harmonized Sales Tax recoveries). This containerized collection contract service award will commence on June 27, 2026 and will end on June 24, 2033.
