City Council Decision
City Council on July 23 and 24, 2025, adopted the following:
1. City Council adopt the confidential instructions to staff in Confidential Attachment 1 to the report (July 11, 2025) from the City Solicitor.
2. City Council authorize the public release of the confidential instructions to staff in Confidential Attachment 1 and Confidential Appendix A to the report (July 11, 2025) from the City Solicitor.
3. City Council direct that the balance of Confidential Attachment 1 to the report (July 11, 2025) from the City Solicitor remain confidential at the discretion of the City Solicitor, as it contains advice that is subject to solicitor-client privilege.
The confidential instructions to staff in Confidential Attachment 1 to the report (July 11, 2025) from the City Solicitor were adopted by City Council and are now public as follows:
1. City Council accept the without prejudice offer to settle dated July 8, 2025 set out in Confidential Appendix A to the report (July 11, 2025) from the City Solicitor and direct the City Solicitor to attend at the Ontario Land Tribunal in support of the settlement.
2. City Council instruct the City Solicitor to request the Ontario Land Tribunal to withhold its Order until the City Solicitor has advised that:
a. the final form and content of the Official Plan and Zoning By-law Amendments are satisfactory to the Executive Director, Development Review and the City Solicitor;
b. the owner, at its sole expense has:
i. submitted a revised Functional Servicing and Stormwater Management Report, to determine the stormwater runoff, sanitary flow and water supply demand resulting from this development, and whether there is adequate capacity in the existing municipal infrastructure to accommodate the proposed development to the satisfaction of the Director, Engineering Review; and
ii. submitted revised civil drawings and bridge retaining wall design reports to determine bridge connection specifications and whether upgrades to the municipal infrastructure are necessary to accommodate the proposed development to the satisfaction of the Director, Engineering Review and the General Manager, Transportation Services;
c. the owner has secured the design, construction, and provision of financial securities in respect of any upgrades or required improvements to the existing municipal infrastructure identified in the accepted Engineering Reports, to support the development, in a financial secured agreement, all to the satisfaction of the Director, Engineering Review, should it be determined that upgrades are required to infrastructure to support the development according to the accepted Functional Servicing and Stormwater Management Report;
d. the owner has ensured that implementation of the accepted Engineering Reports does not require changes to the proposed amending By-law or that any required changes have been made to the proposed amending By-law to the satisfaction of the Executive Director, Development Review and the City Solicitor, including the use of a Holding ("H") Bylaw symbol regarding any new municipal servicing infrastructure or upgrades to existing municipal servicing infrastructure, as may be required;
e. the owner has submitted a revised Hydrological Investigation Report, and Hydrological Review Summary Form, Servicing Report Groundwater Summary Form, and Foundation Drainage Summary Form to the satisfaction of the Director, Engineering Review;
f. the owner has provided a revised Transportation Impact Study to ensure that it reflects the concept set out in Confidential Appendix A to the report (July 11, 2025) from the City Solicitor;
g. the owner has submitted a revised Compatibility Mitigation Study to reflect the updated plans, to the satisfaction of the Executive Director, Development Review; a third-party peer review of the air quality analysis will be completed as part of the site plan process; and
h. the owner has submitted a revised Noise Study to reflect the updated plans, to the satisfaction of the Executive Director, Development Review.
3. City Council authorize the City Solicitor to take all necessary actions to implement City Council's decision.
Confidential Appendix A the report (July 11, 2025) from the City Solicitor is now public and can be accessed under Background Information (City Council).
The balance of Confidential Attachment 1 to the report (July 11, 2025) from the City Solicitor remains confidential at this time in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice that is subject to solicitor-client privilege. The balance of Confidential Attachment 1 to the report (July 11, 2025) from the City Solicitor will be made public at the discretion of the City Solicitor.
