City Council Decision
City Council on October 9 and 10, 2024, adopted the following:
1. City Council amend the Official Plan for the lands at 565 Kennedy Road substantially in accordance with the draft Official Plan Amendment attached as Attachment 5 to the report (June 24, 2024) from the Director, Community Planning, Scarborough District.
2. City Council amend Zoning By-law 569-2013, as amended, for the lands at 565 Kennedy Road substantially in accordance with the draft Zoning By-law Amendment attached as Attachment 6 to the report (June 24, 2024) from the Director, Community Planning, Scarborough District, as amended by Parts 3 and 4 below.
3. City Council amend the Draft Zoning By-law Amendment in Attachment 6 to the report (June 24, 2024) from the Director, Community Planning, Scarborough District to amend the CR Exception in Clause 4 as follows:
a. amend (G) such that it reads:
G. Despite regulation 40.10.40.40(1), the permitted maximum gross floor area of all buildings and structures is 8,600 square metres, of which:
i. the permitted maximum gross floor area for residential uses is 8,250 square metres; and
ii. the permitted maximum gross floor area for non-residential uses is 250 square metres;”
b. amend (H)(ii) such that it reads:
ii. at least 1.75 square meters of outdoor amenity space for each dwelling units of which 40 square metres must be in a location adjoining or directly accessible to the indoor amenity space”
c. amend (O) such that it reads:
O. Despite regulations 230.5.10.1(1)(3) and (5) and Table 230.5.10.1(1), bicycle parking spaces must be provided in accordance with the following minimum rates:
i. 0.68 "long-term" bicycle parking spaces for each dwelling unit;
ii. 0.07 "short-term bicycle parking spaces for each dwelling unit; and
iii. no "short-term" bicycle parking spaces for all non-residential uses on the lot.
d. add the following:
X. Despite Regulation 200.5.10 and Table 200.5.10.1, a minimum of 60 vehicle parking spaces will be provided on the lot, of which a minimum of 8 vehicle parking spaces will be for visitors.”
4. City Council amend Diagram 3 of the Draft Zoning By-law Amendment in Attachment 6 to the report (June 24, 2024) from the Director, Community Planning, Scarborough District to reflect a maximum height permission of 32.5 metres while maintaining the recommended setbacks and stepbacks.
5. City Council determine pursuant to Subsection 34(17) of the Planning Act, and no further public notice is required in respect of the proposed Zoning By-law Amendments Parts 3 and 4 above.
6. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Official Plan Amendment and/or draft Zoning By-law Amendment as may be required.

That:

Summary
This report reviews and recommends approval of the application to amend the Official Plan and Zoning By-law to permit the construction of a 9-storey mixed use building located at 565 Kennedy Road. The application proposes a total gross floor area of 8,430 square metres and will contain 113 residential dwelling units, 220 square metres of ground-level retail, 32 vehicular parking spaces and 114 bicycle parking spaces.
The proposed development is consistent with the Provincial Policy Statement and conforms with the Growth Plan. The proposal amends the Neighbourhoods designation of the Official Plan to Mixed Use Areas to provide for intensification and reurbanization of an underutilized site on a surface transit route in a compact built form that is contextually appropriate.
This report reviews and recommends approval of the application to amend the Official Plan and Zoning By-law and include a Holding (H) provision which will ensure that outstanding engineering issues are resolved to the satisfaction of the Chief Engineer and Executive Director of Engineering and Construction Services prior to permitting development on the subject lands.
