NY15.15 - 6035 Bathurst Street - Zoning By-law Amendment Application - Decision Report - Approval

City Council Decision
City Council on July 24 and 25, 2024, adopted the following:
1. City Council direct the Chief Planner and Executive Director, City Planning to revise the draft Zoning By-law Amendments attached as Attachments 6 and Attachment 7 to the report (June 3, 2024) from the Director, Community Planning, North York District, to:
a. permit the following non-residential uses on the first storey of an apartment building:
1. artist studio, automated banking machine, custom workshop, day nursery, eating establishment, education use, financial institution, medical office, office, performing arts studio, personal service shop, pet services, production studio, recreation use, retail store, retail service, service shop, take-out eating establishment;
b. require a minimum non-residential gross floor area of 65 square metres;
c. require a minimum of 1.7 square metres of indoor amenity space per dwelling unit;
d. increase the setback of the 9-storey podium at the north lot line to a minimum of 5.5 metres; and
e. increase the building height to a maximum of 14-storeys (45.05 metres not including mechanical penthouse).
2. City Council determine that pursuant to Section 34(17) of the Planning Act, as amended, no further notice is required in respect of the proposed amendments to the Zoning By-law.
3. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment(s) as may be required.
4. City Council direct the applicant to provide annual community meetings for the duration of the construction of this project to discuss any concerns raised by the community.
5. City Council direct the City Solicitor to submit the revised Bills for enactment following receipt of written confirmation from the Chief Planner, City Planning Division that the revisions to the Bills as set out in Part 1.a. through 1.e. above, inclusive, have been finalized in accordance with City Council’s direction.
6. City Council request the Chief Planner and Executive Director, City Planning, to consider the following when reviewing the site plan application for the lands at 6035 Bathurst:
a. rebuild the fence shared between 6091 Bathurst and 6035 Bathurst.

Summary
This application proposes to amend the Zoning By-laws to permit a 12-storey (39.05 metres exclusive of mechanical) residential building at 6035 Bathurst Street with 205 dwelling units. The proposed building has a gross floor area (“GFA”) of 13,412 square metres, for a Floor Space Index (“FSI”) of 6.18.
The proposed development is consistent with the Provincial Policy Statement (2020), conforms with A Place to Grow: Growth Plan for the Greater Golden Horseshoe (2020) and conforms with the City of Toronto Official Plan.
This report reviews and recommends approval of the application to amend the Zoning By-law. The proposed building is an appropriate scale for the site given the surrounding mid-rise and tall building context, as well as its location separated from Neighbourhoods lands by the Bathurst Lawn Memorial Park cemetery.
