Motion to Waive Referral (Carried)

Speaker Nunziata advised Council that the provisions of Chapter 27, Council Procedures, require that Motion MM23.14 be referred to the Executive Committee. A two-thirds vote of the Council Members present is required to waive referral.

Point of Order by Councillor Stephen Holyday

Councillor Holyday, rising on a Point of Order, stated that he would like to speak to waiving referral on the item.

Speaker Nunziata accepted the Point of Order and advised Members of Council that there was no rule and asked Councillor Holyday if he would like to speak to waiving referral.


Point of Order by Councillor Gord Perks

Councillor Perks, rising on a Point of Order, stated that, in his memory of the Procedures by-law, where rules do not cover it two things can be brought in: one is typical practice of Council; and two, the Speaker has a right to make a decision. Councillor Perks further stated that the typical practice of Council has been that motions to introduce are not debated and asked the Speaker to rule that Council not do this, because if Councillor Holyday is allowed to do this, the introduction of every Member Motion becomes debatable, and Council will lose hours every meeting. Councillor Perks further stated that Members have a right to an efficient meeting, that allowing debates on introduction of Member Motions would be inefficient, and that if Councillor Holyday believes that the motion is incorrectly before Council, he can ask the Speaker to rule it out of order, and if he wants to speak to the substance of the motion, he can do that once Council has waived referral or when the motion goes to Committee.

Speaker Nunziata accepted the Point of Order and ruled that Councillor Holyday can speak to the Member Motion once it’s been introduced, and as Council agreed yesterday that this Member Motion will be considered with Item CC23.1, the Member Motion will be held.

Councillor Holyday, rising on a Point of Order, stated that he was aware of that and that he would like to speak to the merits of introducing the motion.

Speaker Nunziata accepted the Point of Order and ruled that, while there is no rule, if Council opens that up, they will have Member of Council debating every referral motion introduced at a Council meeting, therefore Councillor Holyday’s request was out of order.

Following Councillor Colle's speaking time on the item, in response to a comment by Speaker Nunziata referring to a conversation they’d had the previous evening, Councillor Colle, rising on a Point of Privilege, stated that the Speaker is impugning his integrity by her comment and that he wants her to withdraw it.
