Community Council Decision
The Etobicoke York Community Council:
1. Granted the application for a fence exemption permit to the property owner of 23 Bradbury Crescent, thereby allowing the property owner to maintain a wood fence on the west side of the property which currently measures 2.1metres in height.
2. Granted the application for a fence exemption permit to the property owner of 23 Bradbury Crescent, thereby allowing the permission to modify or construct the fence in the rear yard on the south property line to a maximum height of 2.1 metres with the following conditions:
a. If the fence is modified or extended, that the materials, facing boards and structural elements are of a similar size, type and dimension and installed in alignment with the existing elements, level and plumb, and all in a good workmanlike manner; and
b. That the existing fence in the rear yard on the west property line, referenced in part 1 above, is modified to ensure that elements are level and plumb, and that the top of the fence face boards are trimmed level and flush with the top rail element.
3. Directed and required the rear yard fences to be maintained in good repair without alteration. At such time as replacement of the fences is required, the installation will comply with Municipal Code Chapter 447, Fences, or its successor by-law.

This staff report concerns a matter for which the Etobicoke York Community Council has delegated authority from City Council to make a final decision.
The purpose of this report is to advise Community Council concerning an application by the property owner of 23 Bradbury Crescent for a site-specific Fence Exemption, pursuant to Section 447-1.5(B) of Toronto Municipal Code, Chapter 447 – Fences. The property owner is seeking Community Council’s permission to maintain a wood fence on the West side of the property measuring 2.1 metres in height and increase the fence height on the South side of the property from 1.8 metres to 2.1 metres in height in height which will not comply with the standards stipulated by Section 447-1.2(A). A Notice of Violation was issued on May 15, 2024, relating to the fence height on the south side of the property.
