Point of Order by Councillor Jennifer McKelvie

Councillor McKelvie, rising on a Point of Order, stated that she wished to be clear that if the motions she moved pass, but the item fails, then the whole Item fails, including the amendments, but that Council can bring those matters forward another time.

Speaker Nunziata accepted the Point of Order and confirmed Councillor McKelvie’s understanding.


Point of Order by Councillor Gord Perks

Councillor Perks, rising on a Point of Order, stated that the main motion by Councillor Moise has a final clause asking for options for implementation as part of the 2024 budget process, and as the budget is already in the Mayor’s hands, there is no way to do this.

Speaker Nunziata accepted the Point of Order and thanked Councillor Perks. Speaker Nunziata ruled that Council will vote on the motion up to the words “report back with findings”, and the rest of the motion is out of order.

Point of Order by Councillor Shelley Carroll

Following the vote to uphold the Chair, Councillor Carroll, rising on a Point of Order, stated the reason why she voted “no” is because she thought it set a dangerous precedent to allow the Speaker to casually amend a motion when something is out of order because of the language in the motion. Councillor Carroll further stated that, rather than placing an amendment to fix the motion, the Speaker just scrapped part of a motion from the Speaker’s Chair, and she wished to know if the Procedural By-law protects Council on that matter.

Speaker Nunziata accepted the Point of Order and ruled that it is up to the Chair, or the Speaker as the case may be, to determine if a portion of a motion is out of order.


Point of Order by Councillor Jennifer McKelvie

Councillor McKelvie, rising on a Point of Order, stated she thought she heard the Clerk say that the Speaker has the ability to rule on a portion of the motion. Councillor McKelvie stated the Speaker ruled the second half of the motion out of order and that's why she stopped it there.

Councillor Carroll, rising on a Point of Order, stated she was seeking clarification on that and did not hear the advice because it was not said into the microphone.
