City Council Decision
City Council on May 10, 11 and 12, 2023, adopted the following:
1. City Council amend Zoning By-law 569-2013 for the lands at 208 Bloor Street West substantially in accordance with the draft Zoning By-law Amendment attached as Attachment 5 to the report (March 23, 2023) from the Acting Director, Community Planning, Toronto and East York District, as amended as follows:
a. limit the permitted and conditional non-residential uses on the second floor to those uses in clauses 40.10.20.10 and 40.10.20.20, respectively, namely:
i. Artist Studio;
ii. Community Centre;
iii. Education Use;
iv. Museum;
v. Performing Arts Studio;
vi. Post-Secondary School;
vii. Wellness Centre;
viii. Custom Workshop (16); and
ix. Private School (28).
2. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment as may be required.
3. Before introducing the necessary Bills to City Council for enactment, City Council require the owner to submit a Functional Servicing and Stormwater Management Report for review and acceptance to the satisfaction of the Chief Engineer and Executive Director, Engineering and Construction Services.
4. City Council request the Chief Planner and Executive Director, City Planning to secure the following through the site plan approval process:
a. an outdoor seating area, to be located within or adjacent to the public right-of-way on Bloor Street West for public use in consultation with Transportation Services;
b. a low-carbon energy strategy as part of the site plan agreement that includes the following sustainability measures:
a. low carbon building heating and cooling, including:
i. primary building heat and cooling from an electric heat pump system;
ii. methane gas combustion systems only for supplemental (peak load) building heat; and
iii. Energy Recovery Units that provide sensible and latent heat recovery from ventilation in each suite;
b. ample electrical outlets for bicycle charging in the interior bicycle parking area;
c. fixtures and appliances that are efficient in their use of water and energy;
d. capturing rainwater and using it for toilet flushing;
e. electric-only appliances or fireplaces; and
f. motion sensor-controlled LED lighting in common areas; and
c. the owner to evaluate wind impacts on neighbouring balconies after construction, in accordance with wind study terms of reference acceptable to the Chief Planner and Executive Director, City Planning, and to take remedial measures if adverse wind effects have increased.
5. City Council allow the owner of 208 Bloor Street West to provide the following as in-kind contributions pursuant to subsection 37(6) of the Planning Act, all to be secured through an agreement entered into pursuant to subsection 37(7.1) of the Planning Act (an "In-kind Contribution Agreement"):
a. at least two BikeShare E-bike stations, within 2 kilometres of 208 Bloor Street West, in accordance with equipment specifications and locations acceptable to the President, Toronto Parking Authority;
b. an outdoor drinking water fountain or water bottle filling facility for public use, to be accessible from the public right-of-way on Bloor Street West, with specifications and location acceptable to Toronto Water and Transportation Services, to dispense drinking water, without charge, from May 15 to October 15 each year, or such other dates as the City-owned water fountains are operated, whichever is longer; and
c. upgrades to City-owned cultural facilities, including but not limited to the theatre rehearsal and performance space at 877 Yonge Street, in a manner acceptable to the General Manager, Economic Development and Culture at a total cost to the owner of up to 4 percent of the value of the land (net of any exclusions or exemptions authorized under the Community Benefits Charge By-law), as determined the day before the day the building permit is issued in respect of the development, with the projected costs of the in-kind contributions to be evidenced through cost estimates provided by the owner and approved by the City.
6. City Council authorize the Chief Planner and Executive Director, City Planning to enter into an In-kind Contribution Agreement to address the provision of the in-kind contributions identified above to the satisfaction of the Chief Planner and Executive Director, City Planning and the City Solicitor, with such agreement to be registered on title to the lands, which agreement shall be evidence of arrangements for the provision of the in-kind contribution that are satisfactory to City Council.
7. City Council request the General Manager, Transportation Services to review and report back on the feasibility of amending Schedule B of the City of Toronto Municipal Code, Chapter 925, Permit Parking, to exclude the development located at 208 Bloor Street West from Permit Parking Area 5E.

That in accordance with the provisions of Chapter 27, Council Procedures, the Toronto and East York Community Council reconsider Item TE4.10.
