The Toronto and East York Community Council:

1. Authorized the continuation of the closure of the south sidewalk on Shuter Street, between Mutual Street and a point 35 metres east, and provision of a temporary pedestrian walkway within the closed portion of the eastbound curb lane from February 24, 2023 to October 31, 2023.

2. Authorized the continuation of the closure of a 2.1-metre-wide portion of the most southerly eastbound curb/bike lane on Shuter Street, between Mutual Street and a point 35 metres east, from February 24, 2023 to October 31, 2023.

3. Authorized the continuation of the closure of the east sidewalk on Mutual Street, between Shuter Street and a point 37 metres south, from February 24, 2023 to October 31, 2023.

4. Authorized the continuation of the closure of an 8-metre-wide portion of the northbound curb lane and adjacent lane on Mutual Street, between Shuter Street and a point 37 metres south, from February 24, 2023 to October 31, 2023.

5. Directed the applicant to pressure wash or sweep (weather permitting) the construction site and adjacent sidewalks and roadways daily, or more frequently as needed to be cleared of any construction debris and made safe.

6. Directed the applicant to continue to ensure that the existing sidewalks or the proposed pedestrian walkways have proper enhanced lighting to ensure safety and visibility at all times of the day and night.

7. Directed the applicant to continue to clearly consult and communicate all construction, parking and road occupancy impacts with local Business Improvement Areas and resident associations in advance of any physical road modifications.

8. Directed the applicant to continue to install appropriate signage and converging mirrors to ensure that pedestrians, cyclists and motorists safety is considered at all times.

9. Directed the applicant to continue to provide a sufficient number of traffic control persons as determined by the Work Zone Traffic Coordinator and the Toronto Police Construction Liaison Officer, on a daily basis to control construction vehicle access and egress to and from the site and maintain a safe environment for the public.

10. Directed the applicant to continue to provide a sufficient number of pay-duty Police Officers as determined by the Work Zone Traffic Coordinator and the Toronto Police Construction Liaison Officer, during large scale concrete pours and large scale material deliveries to control vehicle access and egress to and from the site and maintain a safe environment for the public.

11. Directed the applicant to continue to install cane detection within the covered and protected walkway to guide pedestrians who are visually impaired.

12. Directed the applicant to continue to post a 24-hour monitored construction hotline number on the hoarding board, which must be prominently placed and legible from 20 metres and on all elevations from the construction site.

13. Directed the applicant to continue to provide and install public art, including mural artwork, onto every elevation of the hoarding board with adequate spotlighting for night-time illumination, at their sole cost, to the satisfaction of the Ward Councillor.

14. Directed that Shuter Street and Mutual Street be returned to their pre-construction traffic and parking regulations when the project is complete.

15. Directed the applicant to continue to create a publicly accessible website with regular construction updates and post the website address on the construction site hoarding, which must be prominently placed and legible from 20 metres and on all elevations from the construction site.

16. Directed the applicant, in consultation with Transportation Services, to continue to maintain any bike lanes, and install appropriate signage to inform drivers and cyclists of any changes to the cycling lanes.

17. Directed the applicant to continue to establish a construction management working group that meets monthly and to invite local stakeholders including Transportation Services, Municipal Licensing and Standards, Toronto Buildings, adjacent neighbours, local resident groups and local businesses.

18. Directed the applicant to mitigate light pollution by installing a shield/barrier on any lighting standards in close proximity to adjacent residential properties, such as cranes.

19. Directed the applicant to email monthly construction progress reports to the local Councillor, local residents’ association and the Business Improvement Area Board of Management.

This staff report is about a matter that Community Council has delegated authority from City Council to make a final decision.

Hyde Park Homes Limited Partnership is constructing a 32-storey residential development building at 79-85 Shuter Street. The site is located on the southeast corner of Shuter Street and Mutual Street.

At its meeting on November 10, 2020, Toronto and East York Community Council approved the construction staging areas on Shuter Street and Mutual Street, from November 12, 2020 to April 30, 2022. The south sidewalk and a 2.1-metre-wide portion of the eastbound curb lane on Shuter Street, between Mutual Street and a point 35 metres east, were closed for construction staging operations, with the bike lane on Shuter Street maintained at 1.6 metres in width and pedestrian operations on the south side of Shuter Street maintained in a 1.5-metre-wide covered and protected walkway within the closed portion of the existing lane. Since the report was prepared, the City implemented geometric and pavement marking changes on Shuter Street. These changes resulted in the bike lanes on the north and south sides of Shuter Street being relocated from inside parking lanes to immediately next to the curbs, adding a median on the north side to create separation between parking spaces and the north side bike lane, and the elimination of a parking lane on the south side (which was initially part of the staging area). These changes resulted in a reduced overall space for eastbound traffic, where it was no longer possible to maintain a separate bike lane during construction staging. The developer installed appropriate signage warning bikes and vehicle traffic to merge into the single eastbound traffic lane.

In accordance with the above noted Community Council approval, the east sidewalk and an eight-metre-wide portion of the northbound curb lane and adjacent lane on Mutual Street, between Shuter Street and a point 37 metres south are closed for construction staging. Pedestrian operations on the east side of Mutual Street are maintained in a covered and protected walkway within the closed portion of the existing northbound lane.

The developer has requested an extension of the duration of the construction staging areas on Shuter Street and Mutual Street as the site has experienced COVID-19 related delays.

Transportation Services is requesting authorization to extend the duration of the construction staging areas from February 24, 2023 to October 31, 2023 to allow for the construction of the development to be completed.
