Decision Advice and Other Information

The Property Standards Committee, Etobicoke York Panel gave the following reasons for its decision:

Item Numbers 1 and 2 of the Property Standards Order were confirmed as the appellant advised the Committee, this work had been completed.

Item Number 3 was confirmed as the floor covering in question as per the collective evidence provided by the appellant, the City of Toronto Property Standards Officer, and the tenant has been in place for some time, approximately 30 plus years, approximately. Further, the appellant, the tenant, and City of Toronto Property Standards staff were unable to verify when; and who had actually installed the floor covering in question. As such, the Committee determined that Section 26.C as referenced in the order, applied.

Item Number 4 was rescinded as the Property Standards Order incorrectly identified the bylaw section as 27.B; whereas it should have referenced 27.A as was re-confirmed by the City of Toronto Property Standards Officer during the meeting.
