Community Council Decision
North York Community Council:
1. Authorized the Executive Director, Municipal Licensing and Standards, or the General Manager, Transportation Services, to exempt curb lane café permit area at 3441 Yonge Street, Trattoria Otto, from the requirement of § 742-10.4. A(4) of City of Toronto Municipal Code Chapter 742, Sidewalk Cafés, Parklets and Marketing Displays.

Summary
Trattoria Otto restaurant, located at 3441 Yonge Street, had submitted an application for a curb lane café. Following a feasibility assessment by CaféTO staff, it was determined that the café would not meet the 15 metre setback requirement from the intersection at Yonge Street, between Glen Echo Road and Teddington Park Avenue, as per City of Toronto Municipal Code Chapter 742, Sidewalk Cafés, Parklets and Marketing Displays. The curb lane café would only be setback 12.9 metres and on this basis the application was refused.
After further discussions with Transportation staff, they examined the corner setback more closely and feel that a reduced intersection setback of 12.6 metres would not compromise safety and would support the applicant's request for curb lane café.
This motion would provide the pathway to exempt Trattoria Otto restaurant from the setback requirement of Municipal Code Chapter 742, Sidewalk Cafes, Parklets and Marketing Displays, and allow them to install a frontage curb lane café.
