At the City Council meeting on November 23 and 24, 2022, notice of potential amendments to Chapter 27, Council Procedures was given to permit consideration at a future Council meeting.
City Council Decision Advice and Other Information
Speaker Nunziata advised Council of the following:
Members, during yesterday's session the Mayor indicated that an agenda item related to Bills 3 and 39 would be considered at the December meeting.
That agenda item may include proposed amendments to the Council Procedures, Chapter 27 of the Toronto Municipal Code - to align it with the new statutory provisions.
The City Clerk has asked me to therefore give notice, as required by Section 27-3.6 of the Council Procedures, that amendments to the Council Procedures are likely to be proposed at our next meeting.
This notice will be recorded in the minutes of this meeting.
Motions (City Council)
Councillor Perks, rising on a Point of Order, stated that he recalls that when Council follows the process to have notice that the procedures by-law is coming, it is considered by Committee of the Whole.
John Elvidge, City Clerk, advised Council that there is no Committee of the Whole rule related to that process. The City Clerk further advised that Council may amend its procedures by-law by either having it come through committee or giving notice at the previous Council meeting.
Councillor Perks, rising on a Point of Order, stated that his memory of the procedures by-law was that when Council, either receiving it from committee or giving notice, as Council has just done, asks for a debate at a subsequent Council meeting on the procedures by-law, it is considered by Committee of the Whole.
John Elvidge, City Clerk, advised Council that Councillor Perks's recollection was not correct.
Councillor Perks, rising on a Point of Order, stated that he had received information that there was strong likelihood that the Provincial Legislature will have its committee hearings on Bill 39 next week and will be in a position to approve Bill 39 prior to the next Council meeting. Councillor Perks further asked if Council had received any information from Queen's Park on that.
Councillor Perks, rising on a Point or Order, stated that he would like to know if, in the event Council, the Mayor, or the City Manager receives any information to that effect, a special meeting of Council could be arranged prior to final debate at the Legislature on Bill 39. Councillor Perks further asked if the Mayor would like to comment.
Councillor Perks, rising on a Point or Order, stated that this was his Point of Order. Councillor Perks further stated that Council heard from the Mayor yesterday the Mayor's intention for Council to have an opportunity to debate Bill 39 at Council, and now Councillor Perks had the information that the Legislature had scheduled committee hearings for next week and could likely approve the legislation prior to Council's next meeting. Councillor Perks further stated that he thought Council had an undertaking that Council would have an opportunity to debate the bill and stated that he wanted to know if the Mayor was prepared to call a special Council meeting prior to final debate of Bill 39 at Queen's Park.
Councillor Perks, rising on a Point or Order, stated that he was trying to make a Point of Order to ask his question.
Mayor Tory stated that he has no such information and will check with staff who are preparing a report on Bill 39.
