Motion to Waive Referral (Carried)

Speaker Nunziata advised Council that the provisions of Chapter 27, Council Procedures, require that Motion MM8.22 be referred to the Executive Committee. A two-thirds vote of the Council Members present is required to waive referral.


1 - Motion to Amend Item moved by Councillor Gord Perks (Out of Order)

That City Council delete the Recommendation and adopt instead the following:

 

1. City Council request the City Clerk and the City Manager to include a review of the nomination filing fee and number of endorsements required to be nominated as a Head of Council candidate as part of a larger review of potential electoral reforms for consideration by Council, including the status of previous requests of the Provincial government.

Point of Order by Councillor Stephen Holyday

Councillor Stephen Holyday, rising on a Point of Order, stated that he would like the Speaker to rule on whether or not Motion 1 by Councillor Perks is in order on the grounds that Section 27-9.6 C(2) of Chapter 27, Council Procedures, which says that an amendment is out of order if it is a substantive motion on other business beyond the subject matter of the main motion. Councillor Holyday stated that the main motion, the motion he has before Council, asks to make a statement to the Minister of Municipal Affairs and Housing, it is direct and an immediate action, while Councillor Perk's motion essentially pushes the idea off to something between Council and the Clerk on a report that has not been written and is theoretical in its consideration. Councillor Holyday further stated that it is substantive and changes the motion before Council in a material way, and he believes it is out of order.

Ruling by Speaker Frances Nunziata (Upheld)
Speaker Nunziata accepted the Point of Order and ruled that Motion 1 by Councillor Perks is out of order as it expands the boundaries of Councillor Holyday's motion, and that Councillor Perks could bring his motion through a Committee on his request.
