Speaker Nunziata advised Council that the provisions of Chapter 27, Council Procedures, require that Motion MM7.20 be referred to the Planning and Housing Committee. A two-thirds vote of the Council Members present is required to waive referral.

Point of Order by Councillor Gord Perks

In response to statements made by Speaker Nunziata regarding the debate being focused on MM7.20, Councillor Perks, rising on a Point of Order, stated that many Members expressed their confusion about how there are two intimately related Items, MM7.20 and MM7.43, and he is trying to understand how Council will ask questions on this, or will the same issue be debated twice.

Speaker Nunziata accepted the Point of Order and sought to get clarification from the City Clerk.


Point of Order by Councillor Stephen Holyday

Councillor Holyday, rising on a Point of Order, stated that he wanted to clarify that Council will be voting on MM7.20 first and if it fails then MM7.43 is redundant.

Speaker Nunziata accepted the Point of Order and asked the City Clerk to respond.

The City Clerk advised City Council that if Item MM7.20 is voted on and is carried, then MM7.43 is redundant, and if Item MM7.20 fails, then Council will vote on Item MM7.43.

Rulings (City Council)

Ruling by Speaker Frances Nunziata
Speaker Nunziata, upon the advice of the Clerk, ruled that if it's Council's desire, Items MM7.20 and MM7.43 can be combined, but when Council votes, MM7.20 will be first and if it loses, then MM7.43 is redundant. Speaker Nunziata then clarified by saying it was the other way around.
