EY9.7 - 3471 Lake Shore Boulevard West - Zoning By-law Amendment Application - Decision Report - Approval

City Council Decision

City Council on December 13, 14 and 15, 2023, adopted the following:

 

1. City Council amend City of Toronto Zoning By-law 569-2013 for the lands at 3471 Lake Shore Boulevard West substantially-in-accordance with the draft Zoning By-law Amendment attached as Attachment 6 to the report (October 25, 2023) from the Director, Community Planning, Etobicoke York District, as amended by Parts 2 and 3 below.

 

2. City Council amend draft Zoning By-law 569-2013 in Attachment 6 to the report (October 25, 2023) from the Director, Community Planning, Etobicoke York District by amending Exception CR(911) to add the following:

 

a. (N) Despite regulation 200.5.1.10(2) and (14), where stacked parking spaces are provided:

 

i. the required minimum vertical clearance is 1.8 metres;

 

b. despite regulation 40.5.40.40 (3) the gross floor area of a mixed use building is also reduced by the area used for non-residential purposes below grade and parking areas at grade;

 

c. despite regulation 40.5.40.40 (6) non residential floor area below grade shall not be included in the calculation of floor space index;

 

d. provisions of 40.10.40.1(6) (A), 40.10.50.10 (2) shall not apply.

 

3. City Council amend Diagram 5 to draft Zoning By-law 569-2013 in Attachment 6 to the report (October 25, 2023) from the Director, Community Planning, Etobicoke York District to reflect a permitted minimum building setback of 0.0 metres to the east property line.

 

4. City Council determine that the revisions to the draft Zoning By-law Amendment to implement the revisions in accordance with Parts 2 and 3 above are minor in nature and pursuant to Section 34(17) of the Planning Act, and no further public notice is required in respect of the proposed Zoning By-law Amendments.

 

5. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment as may be required.

 

6. City Council require that, before introducing the necessary Bill to City Council for enactment, the applicant shall:

 

a. provide a revised Functional Servicing and Stormwater Management Report to the satisfaction of the Chief Engineer and Executive Director, Engineering and Construction Services;

 

b. provide documentation to the satisfaction of the General Manager, Transportation Services and the City Solicitor that shared vehicular and parking access has been secured with the adjacent property owner at 105 Thirty First Street; and

 

c. address the recommendations contained in the Noise and Vibration Study by J.E. Coulter Associates Limited, dated March 23, 2022, to the satisfaction of the Chief Planner and Executive Director, City Planning.

 

7. City Council authorize the appropriate City officials to take such actions as are necessary to implement City Council's decision.

That:

Summary

This application proposes to amend Zoning By-law 569-2013 for the property at 3471 Lake Shore Boulevard West to permit a six-storey mixed-use building with commercial uses at grade and 19 residential units above. The application includes a total Gross Floor Area (GFA) of 1571.8 square metres, including 1377.8 square metres of residential GFA and 194 square metres of non-residential GFA.

 

This report reviews and recommends approval of the application to amend the Zoning By-law.

 

The proposal is consistent with the Provincial Policy Statement (2020) and conforms with A Place to Grow: Growth Plan for the Greater Golden Horseshoe (2020). It conforms with the Official Plan and is generally consistent with the City's design guidelines. The proposal represents an appropriate level of intensification within the Mixed Use Areas, and an appropriate transition in scale to the adjacent Neighbourhoods to the south.
