City Council Decision

City Council on May 10, 11 and 12, 2023, adopted the following:

 

1. City Council amend City of Toronto Municipal Code Chapter 937, Temporary Closing of Highways, to delegate to the General Manager, Transportation Services, to facilitate the test pit investigation work related to the Ontario Line Don Valley Crossing, despite Section 937-4 of Code Chapter 937, the authority to temporarily close to vehicular traffic:

 

a. the southbound outside lane and adjacent pavement shoulder on the Don Valley Parkway, between 400 metres north of the Leaside Bridge and 100 metres south of Beechwood Drive, from 11:00 p.m. of one day to 5:00 a.m. on the following day for three nights between June 1, 2023 and June 12, 2023, inclusive; 

 

and City Council exempt the General Manager, Transportation Services, in carrying out this delegated authority from Section 937-5 of Chapter 937, that being the requirement to notify the local Ward Councillor of the pending closure and the requirement to report on the proposed closure if so requested by the local Ward Councillor.

 

2. City Council amend City of Toronto Municipal Code Chapter 937, Temporary Closing of Highways, to delegate to the General Manager, Transportation Services, to facilitate the geotechnical investigation site visit related to the Ontario Line Don Valley Crossing, despite Section 937-4 of Code Chapter 937, the authority to temporarily close to vehicular traffic:

 

a. the northbound outside lane and adjacent pavement shoulder on the Don Valley Parkway, between 600 metres south of Beechwood Drive and 350 metres north of Leaside Bridge, from 11:00 p.m. of one day to 2:00 a.m. on the following day for one night between May 15, 2023 and May 31, 2023, inclusive;

 

b. the southbound outside lane and adjacent pavement shoulder on the Don Valley Parkway, between 450 metres north of the Leaside Bridge and 300 metres south of Beechwood Drive, from 11:00 p.m. of one day to 2:00 a.m. on the following day for one night between May 15, 2023 and May 31, 2023, inclusive;

 

c. the northbound inside lane and adjacent pavement shoulder on the Don Valley Parkway, between 600 metres south of Beechwood Drive and 350 metres north of Leaside Bridge, from 2:00 a.m. of one day to 5:00 a.m. of the same day for one night between May 15, 2023 and May 31, 2023, inclusive; and

 

d. the southbound inside lane and adjacent pavement shoulder on the Don Valley Parkway, between 450 metres north of the Leaside Bridge and 300 metres south of Beechwood Drive, from 2:00 a.m. of one day to 5:00 a.m. of the same day for one night between May 15, 2023 and May 31, 2023, inclusive;

 

and City Council exempt the General Manager, Transportation Services, in carrying out this delegated authority from Section 937-5 of Chapter 937, that being the requirement to notify the local Ward Councillor of the pending closure and the requirement to report on the proposed closure if so requested by the local Ward Councillor.

 

3. City Council amend City of Toronto Municipal Code Chapter 937, Temporary Closing of Highways, to delegate to the General Manager, Transportation Services, to facilitate the geotechnical borehole and instrumentation work related to the Ontario Line Don Valley Crossing, despite Section 937-4 of Code Chapter 937, the authority to temporarily close to vehicular traffic:

 

a. the northbound outside lane and adjacent pavement shoulder on the Don Valley Parkway, between 600 metres south of Beechwood Drive and 350 metres north of the Leaside Bridge, for up to and including fifty nights from 11:00 p.m. of one day to 5:00 a.m. of the following day, excluding Saturday and Sunday overnights, between June 12, 2023 and September 1, 2023, inclusive;

 

b. the southbound outside lane and adjacent pavement shoulder on the Don Valley Parkway, between 450 metres north of the Leaside Bridge and 300 metres south of Beechwood Drive, for up to and including thirty-five nights from 11:00 p.m. of one day to 5:00 a.m. of the following day, excluding Saturday and Sunday overnights, between June 12, 2023 and September 1, 2023, inclusive;

 

c. the northbound inside lane and adjacent pavement shoulder on the Don Valley Parkway, between 600 metres south of Beechwood Drive and 350 metres north of the Leaside Bridge, for up to and including eight nights from 11:00 p.m. of one day to 5:00 a.m. of the following day, excluding Saturday and Sunday overnights, between June 12, 2023 and September 1, 2023, inclusive; and

 

d. the southbound inside lane and adjacent pavement shoulder on the Don Valley Parkway, between 450 metres north of the Leaside Bridge and 300 metres south of Beechwood Drive, for up to and including thirteen nights from 11:00 p.m. of one day to 5:00 a.m. of the following day, excluding Saturday and Sunday overnights, between June 12, 2023 and September 1, 2023, inclusive;

 

and City Council exempt the General Manager, Transportation Services, in carrying out this delegated authority from Section 937-5 of Chapter 937, that being the requirement to notify the local Ward Councillor of the pending closure and the requirement to report on the proposed closure if so requested by the local Ward Councillor.

 

4. City Council direct the General Manager, Transportation Services to add as a condition of permit that, between June 12, 2023 and September 1, 2023, inclusive, the Metrolinx contractor will implement only one temporary lane closure per direction per night on the Don Valley Parkway, between 450 metres north of Leaside Bridge and 600 metres south of Beechwood Drive, to facilitate the geotechnical borehole and instrumentation work related to the Ontario Line Don Valley Crossing.

 

5. City Council amend City of Toronto Municipal Code Chapter 937, Temporary Closing of Highways, to delegate to the General Manager, Transportation Services, to facilitate the geotechnical monitoring and measurement work related to the Ontario Line Don Valley Crossing, despite Section 937-4 of Code Chapter 937, the authority to temporarily close to vehicular traffic:

 

a. the northbound outside lane and adjacent pavement shoulder on the Don Valley Parkway, between 600 metres south of Beechwood Drive and 350 metres north of the Leaside Bridge, from 11:00 p.m. of one day to 5:00 a.m. on the following day for one night between September 1, 2023 and September 30, 2023, inclusive;

 

b. the southbound outside lane and adjacent pavement shoulder on the Don Valley Parkway, between 450 metres north of the Leaside Bridge and 300 metres south of Beechwood Drive, from 11:00 p.m. of one day to 5:00 a.m. on the following day for one night between September 1, 2023 and September 30, 2023, inclusive;

g. the northbound outside lane and adjacent pavement shoulder on the Don Valley Parkway, between 600 metres south of Beechwood Drive and 350 metres north of the Leaside Bridge, from 11:00 p.m. of one day to 5:00 a.m. on the following day for one night between July 1, 2024 and July 31, 2024, inclusive; and

 

h. the southbound outside lane and adjacent pavement shoulder on the Don Valley Parkway, between 450 metres north of the Leaside Bridge and 300 metres south of Beechwood Drive, from 11:00 p.m. of one day to 5:00 a.m. on the following day for one night between July 1, 2024 and July 31, 2024, inclusive;

 

and City Council exempt the General Manager, Transportation Services, in carrying out this delegated authority from Section 937-5 of Chapter 937, that being the requirement to notify the local Ward Councillor of the pending closure and the requirement to report on the proposed closure if so requested by the local Ward Councillor.

City Council amend City of Toronto Municipal Code Chapter 937, Temporary Closing of Highways, to delegate to the General Manager, Transportation Services, to facilitate the installation and removal of the temporary slope safety system related to the Ontario Line Don Valley Crossing, despite Section 937-4 of Code Chapter 937, the authority to temporarily close to vehicular traffic:

 

a. the northbound outside lane and adjacent pavement shoulder on the Don Valley Parkway, between 600 metres south of Beechwood Drive and 350 metres north of the Leaside Bridge, from 11:00 p.m. of one day to 5:00 a.m. on the following day for up to and including ten nights between April 1, 2024 and April 30, 2024, inclusive; and

 

b. the northbound outside lane and adjacent pavement shoulder on the Don Valley Parkway, between 600 metres south of Beechwood Drive and 350 metres north of the Leaside Bridge, from 11:00 p.m. of one day to 5:00 a.m. on the following day for up to and including ten nights between June 1, 2027 and June 30, 2027, inclusive;

City Council amend City of Toronto Municipal Code Chapter 937, Temporary Closing of Highways, to delegate to the General Manager, Transportation Service, to facilitate the installation of brackets and conduits on the south side of the existing Lower Don Bridge, despite Section 937-4 of Code Chapter 937, the authority to temporarily close to vehicular traffic:

 

a. the southbound outside lane on the Don Valley Parkway, between 20 metres north of Eastern Avenue and the Don Valley Parkway-F.G. Gardiner Expressway on-ramp, from 11:00 p.m. of one day to 5:00 a.m. on the following day for up to and including eight nights between July 1, 2023 and July 31, 2023, inclusive;

 

b. the south-to-westbound outside lane on the Don Valley Parkway-F.G. Gardiner Expressway on-ramp, between the Don Valley Parkway and a point 150 metres south, from 11:00 p.m. of one day to 5:00 a.m. on the following day for up to and including eight nights between July 1, 2023 and July 31, 2023, inclusive;

a. the southbound inside lane on the Don Valley Parkway, between 250 metres north of Gerrard Street and the Don Valley Parkway-F.G. Gardiner Expressway on-ramp, from 11:00 p.m. of one day to 5:00 a.m. on the following day for up to and including four nights between September 1, 2025 and September 30, 2025, inclusive, for one night between December 1, 2026 and December 31, 2026, inclusive, and for up to and including three nights between October 1, 2026 and January 31, 2027, inclusive;

City Council amend City of Toronto Municipal Code Chapter 27, Council Procedures, to provide that the current delegation to Community Council to temporarily close public lanes or public alleys, local roads, collector roads, and minor arterial roads, does not include closures delegated to the General Manager, Transportation Services, in carrying out the authority in Part 13 above.

 

15.  City Council temporarily close the southbound outside lane and adjacent pavement shoulder on the Don Valley Parkway, between 400 metres north of the Leaside Bridge and 100 metres south of Beechwood Drive, from 11:00 p.m. of one day to 5:00 a.m. on the following day from December 1, 2023 to March 31, 2024, inclusive, in order to conduct retaining wall construction and storm sewer relocation related to the Ontario Line Don Valley Crossing.

 

16. City Council authorize the City Solicitor to introduce the necessary Bills to give effect to City Council's decision and City Council authorize the City Solicitor to make any necessary clarifications, refinements, minor modifications, technical amendments, or by-law amendments as may be identified by the City Solicitor or General Manager, Transportation Services, in order to give effect to Parts 1 to 14 above, inclusive.

g. the Don Roadway, southbound, between the Don Valley Parkway and Lake Shore Boulevard, from 11:00 p.m. of one day to 5:00 a.m. on the following day for one night between June 1, 2026 and June 30, 2026, inclusive, for up to and including two nights between July 1, 2026 and July 31, 2026, inclusive, for one night between August 1, 2026 and August 31, 2026, inclusive, for one night between September 1, 2026 and September 30, 2026, inclusive, for one night between October 1, 2026 and October 31, 2026, inclusive, for one night between November 1, 2026 and November 30, 2026, inclusive, and for up to and including four nights between December 1, 2026 and January 27, 2027, inclusive, to facilitate the tightening of bridge cables, removal of bridge arch bracing, installation of debris shield, bridge deck concrete placement, bridge railing curb placement, removal of debris shield and finishing of the bridge structure related to the Ontario Line Lower Don Bridge; and

 

h. the Don Roadway, northbound, between Lake Shore Boulevard and the Don Valley Parkway, from 11:00 p.m. of one day to 5:00 a.m. on the following day for one night between June 1, 2026 and June 30, 2026, for up to and including two nights between July 1, 2026 and July 31, 2026, inclusive, for one night between August 1, 2026 and August 31, 2026, inclusive, for one night between September 1, 2026 and September 30, 2026, inclusive, for one night between October 1, 2026 and October 31, 2026, inclusive, for one night between November 1, 2026 and November 30, 2026, inclusive, and for up to and including four nights between December 1, 2026 and January 27, 2027, inclusive, to facilitate the tightening of bridge cables, removal of bridge arch bracing, installation of debris shield, bridge deck concrete placement, bridge railing curb placement, removal of debris shield and finishing of the bridge structure related to the Ontario Line Lower Don Bridge;

 

and City Council exempt the General Manager, Transportation Services, in carrying out this delegated authority from Section 937-5 of Chapter 937, Temporary Closing of Highways, that being the requirement to notify the local Ward Councillor of the pending closure and the requirement to report on the proposed closure if so requested by the local Ward Councillor.

 

14. City Council amend City of Toronto Municipal Code Chapter 27, Council Procedures, to provide that the current delegation to Community Council to temporarily close public lanes or public alleys, local roads, collector roads, and minor arterial roads, does not include closures delegated to the General Manager, Transportation Services, in carrying out the authority in Part 13 above.

 

15.  City Council temporarily close the southbound outside lane and adjacent pavement shoulder on the Don Valley Parkway, between 400 metres north of the Leaside Bridge and 100 metres south of Beechwood Drive, from 11:00 p.m. of one day to 5:00 a.m. on the following day from December 1, 2023 to March 31, 2024, inclusive, in order to conduct retaining wall construction and storm sewer relocation related to the Ontario Line Don Valley Crossing.

 

16. City Council authorize the City Solicitor to introduce the necessary Bills to give effect to City Council's decision and City Council authorize the City Solicitor to make any necessary clarifications, refinements, minor modifications, technical amendments, or by-law amendments as may be identified by the City Solicitor or General Manager, Transportation Services, in order to give effect to Parts 1 to 14, inclusive.

Summary

This report provides an overview of Metrolinx's plans to construct the Ontario Line Don Valley Crossing and Lower Don Bridge, the two new bridges to carry the Ontario Line across the Don Valley Parkway. Construction of these new bridges will require multiple temporary lane closures on the Don Valley Parkway, F.G. Gardiner Expressway, and the Don Roadway between 2023 and 2028. The report discusses various construction activities and the number and duration of the temporary lane closures.

 

In addition, the report requests City Council amendment to City of Toronto Municipal Code Chapter 937, Temporary Closing of Highways, in order to provide for various temporary delegations of authority to the General Manager, Transportation Services to implement lane closures on the Don Valley Parkway and F.G.
