The Property Standards Committee, North York Panel:

1. Confirmed the Order to Comply (March 25, 2022) for 55 Eccleston Drive, Folder Number: 22 125757 PRS 00IV, and, in doing so, granted an extension of time to October 31, 2022.

The Property Standards Committee, North York Panel gave the following reasons for its decision:

The Property Standards Committee, North York Panel agreed to confirm the Order to Comply (March 25, 2022) for 55 Eccleston Drive, Unit 404, Folder Number 22 125757 PRS 00 IV and extend the time to complete for compliance because of the appellant’s difficulty in obtaining entry into the apartment to rectify the items listed in the Order to Comply, as well as other building infrastructure upgrades that are not part of the Order to Comply. The Panel accepted that the appellant has been in a lengthy dispute with the tenant and is in the process of having the tenant evicted. Once the tenant has been evicted, the appellant has promised to correct all deficiencies to make the unit functional, safe, and clean. It is unknown exactly when the proceedings against the tenant will conclude and Municipal Licensing and Standards is willing to be flexible and fair in ensuring the appellant has sufficient time if necessary beyond October 31, 2022. The appellant has promised to keep Municipal Licensing and Standards informed of their progress and to provide documentation in support of their delays to ensure the channels of communication between Municipal Licensing and Standards and the appellant remain open and amicable.
