Scarborough Community Council:
1. Granted the application for an exemption permit by the owner(s) of 36 Windover Drive, to allow them to maintain a wooden fence in the east side yard that measures 2.4 metres (7.9 Feet) in height and constructed with materials not usually intended for use in permanent fencing. Directed and required that the existing fence be maintained in good repair without alteration. Directed and required that at such time as a replacement of the fence is required that such installation will comply with Municipal Code Chapter 447, Fences, or its successor by-law.

The purpose of this report is to consider an application by the owner(s) of 36 Windover Drive, to maintain a wooden fence on the east side yard that measures 2.4 metres (7.9 feet) in height, which exceeds the maximum allowable height of 2.0 meters and is constructed with materials not usually intended for use in permanent fencing as specified in the Toronto Municipal Code, Chapter 447-1.2B(1) Table 1 – Maximum Height of Fences Item 9 and 447 1.2(5) Materials not usually intended for use in permanent fencing. A Notice of Violation was issued on September 3, 2021.
