The Toronto Preservation Board recommends that:

1. City Council adopt the confidential recommendations contained in Confidential Attachment 1 to the report (March 22, 2022) from the City Solicitor.

2. City Council authorize the public release of the recommendations in Confidential Attachment 1 and Confidential Appendix "A", Confidential Appendix "B", and Confidential Appendix "C" to the report (March 22, 2022) from the City Solicitor, at the discretion of the City Solicitor.

3. City Council direct that all other information contained in Confidential Attachment 1 to the report (March 22, 2022) from the City Solicitor is to remain confidential as it contains advice which is subject to solicitor-client privilege and litigation privilege.

Kristen Flood, Planner, Heritage Preservation, Urban Design, City Planning gave a presentation on 958 Broadview Avenue - Request for Directions Report.

The Toronto Preservation Board recessed its public session to meet in closed session to consider this item as it relates to the receiving of advice that is subject to solicitor-client privilege and contains information regarding potential litigation.

On July 20, 2021, the applicant appealed the Zoning By-law Amendment and Official Plan Amendment application to the Ontario Land Tribunal ("OLT") due to Council not making a decision within the 120-day time frame in the Planning Act.
