October 27, 2020 at 10:11 am - Speaker Nunziata advised Council of the following:
Members, I will now review the Order Paper.
We have two deferred Committee Items:
IE15.11 on a request to get Bike Lanes in Midtown along Yonge Street, and
SC12.4 on 1-70 Eglinton Square, 1431 and 1437 Victoria Park Avenue, 14, 18, 19, 22, 23 and 26 Engelhart Crescent and 64 and 68 Harris Park Drive - Official Plan Amendment Application - Request for Direction Report
We also have a deferred Member Motion, MM25.1 on supporting taxi operators from COVID-related Financial Hardship. City Council has already taken the necessary procedural steps to introduce this Motion, and it is before Council for debate. Although the Motion appears later in the agenda, it will be brought forward for consideration after the other deferred items.
The Mayor has designated Item EX17.1 on "Towards Recovery and Building a Renewed Toronto" as his first Key Matter and first item of business today.
The Mayor has designated Item EX17.7 on "Winter Patio Permissions" as his second Key Matter and second item of business today. There is a related matter on the agenda, Item PH17.12 on the temporary use by-law to expand permissions for outdoors patios for bars and restaurants. I propose that it be considered with the Mayor's second Key Matter.
There are also two related matters on the agenda that I propose be considered together:
Item EC16.1 on the Interim Shelter Recovery and Infrastructure Implementation Plan with Item GL16.6 on the Co-location of Housing and Service Integration at 2950 and 2970 Lake Shore Boulevard West.
The Notice of Motion run through is scheduled for 2 p.m. tomorrow only if the Mayor's Key Matters are completed.
I propose that City Council set a time for a closed session, if required, later in the meeting.
I will now go through the items to take additional Member holds. I will review the Order Paper one section at a time, starting with the deferred items.
The Clerk will open the speakers list in CMP and you can place your name on the list. When I recognize you, unmute your mic and state the item or items you wish to hold.
That City Council consider Item HL22.1 as the first Item of business on Wednesday, October 28, 2020.
That City Council bring Member Motion MM25.10 forward as an urgent item not subject to referral to committee.
That in accordance with Section 27-7.10 of Council Procedures, City Council remove Items:

That City Council consider Member Motion MM25.32 headed "Implementation of the Federal Rapid Housing Initiative" at 11:00 a.m. today.
October 30, 2020 at 9:46 a.m. - That City Council adopt the October 30, 2020 Order Paper, as amended.
Councillor Carroll, on a Point of Order, stated that she heard the Speaker propose combining an Item with a Mayor's Key Matter and asked when she might raise an objection to that proposal.
Councillor Carroll, on a Point of Order, stated that at the last few meetings Council has joined a larger Omnibus Item about COVID response with another Item, expressed her concern that having only 5 minutes to ask questions is a tall order for Members to get answers to their questions, and stated that she is not in support of joining the items.
Mayor Tory, on a Point of Order, stated he believed Councillor Carroll had misunderstood which items were being combined and that he had only consented to the joining of two narrow, related items about winter Patios, Item EX17.7 and Item PH17.12.
Councillor Carroll thanked the Mayor for the clarification and withdrew her objection.
Councillor Perks, on a Point of Order, stated that he wanted clarification on the Speaker's earlier ruling when Councillor Carroll had objected to the Speaker's proposal to join another Item with the Mayor's second Key Matter, and whether the Speaker had ruled that the proposal was subject to a vote.
Councillor Fletcher, on a Point of Order, asked the Speaker to clarify if Council would be voting on combining the two items.
Mayor Tory, on a Point of Order, stated that as these issues are important as matters of precedent, he would like the Clerk to clarify the procedures for joining an Item with a Mayor's Key Matter.
The Interim City Clerk advised Council that, as is convention during the Order Paper review, the Speaker may propose that related Items be considered together, and that the Speaker is essentially placing motion to combine two items. If a Member objects, it is appropriate to put the proposal to a vote. In the special case of a Mayor's Key Matter, such as EX17.7, the Speaker has proposed to join it with another item on the agenda. The Mayor can identify up to two Key Matters for the meeting, and the Mayor's consent to join an Item with his Key Matter is required, as under the Council Procedures, the Mayor may fix the time and the circumstances under which his Key Matters are considered. As a courtesy, the Speaker seeks the Mayor's consent to join an Item to his Key Matter. The Mayor can withhold his consent and if so, the Items would be considered separately as the Speaker's proposal would then be out of order.
Mayor Tory, on a Point of Order, stated that he wishes the Clerk to clarify whether his refusal or consent to the joining of an Item with his Key Matter is subject to a vote.
The Interim City Clerk advised Council that the Mayor's consent or the withholding of consent is not subject to a vote. What was subject to a vote in this instance was the Speaker's proposal to join two matters together.
Deputy Mayor Minnan-Wong, on a Point of Order, stated that discussion about considering Item MM25.10 at this point in the meeting was not in order because Council hadn't decided whether to introduce it.
Councillor Carroll, on a Point of Order, stated that Motion MM25.10 does not require introduction.
The Interim City Clerk advised Council that while it is normally Council's practice to consider Member Motions on the second day of a Council Meeting at 2:00 p.m., Council has considered Member Motions earlier in the meeting or as timed items, and that the required two-thirds majority votes to waive referral or waive notice would still apply.
