1.  Approved the appeal of the extended walkway at 12 Delroy Drive, such walkway to be properly maintained and with the final design to be approved by the Director, Transportation Services, Etobicoke York District.

 

2.  Denied the appeal of the retaining wall and vegetation (height).

Summary

This staff report is regarding a matter that the Etobicoke York Community Council has delegated authority from City Council to make a final decision.

 

This report recommends that the Etobicoke York Community Council make a decision on whether the City of Toronto enters into an encroachment agreement for an extended walkway being used as a parking pad and landscape design at 12 Delroy Drive.

 

The property located at 12 Delroy Drive currently has multiple deficiencies that contravene Chapter 743 of the Toronto Municipal Code as follows:

 

1. Does not provide a setback of three metres to allow for general municipal maintenance on the Public Right-of-Way in a safe and effective manner.

 

2. A walkway exceeding the allowed width of 1.5 metres, which is being used as a parking pad.

 

3. Vegetation that exceeds a height of 0.85 metres, which causes sightline and safety concerns for pedestrians, cyclists, vehicles, etc.

 

As such, the proponent is seeking to appeal the decision and conditions provided by Transportation Services and enter into an encroachment agreement.

That Etobicoke York Community Council amend Recommendation 1 contained in the report (August 17, 2020) from the Director, Permits and Enforcement, Transportation Services, to now read as follows:

 

1.  Etobicoke York Community Council:

 

a. Approve the appeal of the extended walkway at 12 Delroy Drive, such walkway to be properly maintained and with the final design to be approved by the Director, Transportation Services, Etobicoke York District.

 

b.  Deny the appeal of the retaining wall and vegetation (height).
