The Board of Governors of Exhibition Place:

1.  Concurred with the action taken by the Chair of the Board and the Chief Executive Officer, Exhibition Place in approving the award of Contract No. 20-076-20762 (Request For Tender Number EP101-2020) to Bird Mechanical Ltd. of Newmarket, Ontario (Bird) for replacement of Chiller No. 2 at Enercare Centre in the amount of $1,611,868.00 plus a contingency allowance of $100,000.00 but excludes HST; this being the lowest acceptable tender submission received following the public tendering of the project.

This report recommends approving a contract with Bird Mechanical Ltd. of Newmarket, Ontario for replacement of Chiller No. 2 at Enercare Centre ("ECC"). The Tender Call was issued on March 2, 2020, through Exhibition Place Purchasing and Materials Stores Online Procurement System and on MERX Canada's leading electronic tendering service for Canadian public sectors organization, and the recommendation is to award the contract to the lowest bidder meeting specifications within the available budget.

Due to COVID-19 and the cancellation of the April 22, 2020 Board meeting, in order to meet timelines for contract documentation and operational needs, the Chair of the Board in consultation with the CEO of Exhibition Place, approved this contract award pursuant to the authority under the Financial By-law 2-18, Article X and seek concurrence of the Board.
