Item - 2020.CC27.9

City Council on December 16, 17 and 18, 2020, adopted the following:

1. City Council approve the City Solicitor's September 8, 2020 and November 30, 2020 applications to participate as an intervenor in the Ontario Energy Board proceedings considering Enbridge's applications for leave to construct a new pipeline to replace the existing pipeline between Cherry Street and Bathurst Street and a 1.9 kilometre 20 inch pipeline along a route through the City of Toronto.

2. City Council direct the City Solicitor, in consultation with the Deputy City Manager, Infrastructure and Development, to deliver evidence and submissions to the Ontario Energy Board and participate in any hearing, including in any procedural or settlement discussions, as permitted by the Ontario Energy Board.

3. City Council adopt the confidential instructions to staff in Confidential Attachment 1 to the report (December 8, 2020) from the City Solicitor.

4. City Council authorize the public release of the confidential instructions to staff in Confidential Attachment 1 to the report (December 8, 2020) from the City Solicitor at the discretion of the City Solicitor.

5. City Council direct that the balance of Confidential Attachment 1 to the report (December 8, 2020) from the City Solicitor remain confidential as it contains advice that is subject to solicitor-client privilege.

Confidential Attachment 1 to the report (December 8, 2020) from the City Solicitor remains confidential at this time in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice that is subject to solicitor-client privilege.  The confidential instructions to staff  in Confidential Attachment 1 to the report (December 8, 2020) from the City Solicitor will be made public at the discretion of the City Solicitor.
