The Toronto and East York Community Council:

1. Approved the installation of two temporary free-standing pillar signs which will encroach within the public right of way fronting 261 Queens Quay East, indicating the businesses to be located on Edgewater Drive, and Merchants Wharf adjacent to the property subject to the owners entering into an encroachment agreement with the City of Toronto agreeing to, but not limited to the following:

a. indemnify the City from and against all actions, suits, claims or demands and from all loss, costs, damages and expenses that may result from such permission granted and providing an insurance policy for such liability for the lifetime of the Agreement in a form as approved by the Deputy City Manager in an amount not less than $5,000,000.00 or such greater amount as the Deputy City Manager and Chief Financial Officer may require;

b. agree that the City and/or utility companies may remove the free standing pillar signs in order to install or maintain services within the affected public right of way with no obligations to replace the encroachments;

c. maintain the signs at their own expense in good repair and a condition satisfactory to the General Manager, Transportation Services and will not make any additions or modifications to the encroachment beyond what is allowed under the terms of the Agreement;

d. pay for the costs of preparing the Agreement and the registration of the Agreement on title;

e. remove the signs upon receiving 90 days written notice to do so;

f. remove the signs when the permanent streetscape plan is implemented on Queens Quay East by Waterfront Toronto;

g. Prior to the issuance of the permit, contact Urban Forestry to enter into any protection plans and/or tree permits for City owned trees that may be in the area and pay any deposits which may be required; and

h. accept such additional conditions as the City Solicitor or the General Manager, Transportation Services may deem necessary in the interest of the City.

This staff report is about a matter which Community Council has delegated authority from City Council to make a final decision.

Transportation Services has assessed a request from Aquavista Bayside Toronto Inc., the owners of the property currently known as 261 Queens Quay East, for the installation of two temporary free-standing pillar signs fronting the premises at 261 Queens Quay East, near the east and west intersections of Merchants Warf. The signs will identify the retail uses which are located out of view on Edgewater Drive and Merchants Wharf adjacent to the subject property.

As the signs are temporary in nature, and will not pose a significant negative impact on the public right of way, Transportation Services recommends approval of the encroachment(s).
