City Council Decision
City Council on February 26, 2019, adopted the following:
1. City Council direct the City Solicitor to appeal the Committee of Adjustment decision on Minor Variance Application A1049/17TEY respecting 878 Palmerston Avenue to the Toronto Local Appeal Body, and City Council authorize the City Solicitor to attend the Toronto Local Appeal Body hearing to request that the conditions contained in the November 16, 2018 Memorandum from the Manager, Development Engineering, Toronto and East York District be imposed.
2. City Council authorize the City Solicitor to take all steps necessary to bring resolution to the appeal, in consultation with the Ward Councillor and the Chief Planner and Executive Director, City Planning.

Community Council Recommendations
The Toronto and East York Community Council recommends that:
1. City Council direct the City Solicitor to appeal the Committee of Adjustment decision on Minor Variance Application No.A1049/17TEY respecting 878 Palmerston Avenue to the Toronto Local Appeal Body, and attend the Toronto Local Appeal Body hearing to request that the conditions contained in the November 16, 2018 Memorandum from the Manager, Development Engineering, Toronto and East York District be imposed; and
2. City Council authorize the City Solicitor to take all steps necessary to bring resolution to the appeal, in consultation with the Ward Councillor and the Chief Planner and Executive Director, City Planning.

Summary
On January 30, 2019 the Committee of Adjustment approved the application for variances at 878 Palmerston Avenue despite communications from the Manager, Engineering and Construction Services requesting that the owner make revisions to the plans to meet Ontario Building Code requirements for fire and safety access, as well as provide drawings showing a fire hydrant located within 45m as required by the building code.
This Motion will authorize the City Solicitor to attend the TLAB in order to oppose the proposed variances and consent requested in the Applications.
This matter is time sensitive and urgent as the deadline for appeals is February 19, 2019.
