That Deputy Mayor Denzil Minnan-Wong be permitted to add to the agenda of today's meeting an urgent Motion without Notice concerning:
Are We there Yet? Assessing the Effectiveness of Toronto's Traffic Congesion Management Plan
Reason for Urgency:
This Motion is urgent as residents continue to wait in traffic, they feel that it is getting worse and it's time to look at the numbers and see if our Congestion Management Plan is making a difference.
That City Council refer the Item to the General Manager, Transportation Services for consideration in an updated Congestion Management Plan, scheduled to be introduced in the spring of 2020.
Councillor Perks, rising on a Point of Order, stated that section 8.4 of the Procedures By-law requires the Clerk, in consultation with the Chair, to either agree that a Motion Without Notice deals with an urgent matter or refer the Motion without Notice to the relevant Council committee. Councillor Perks further stated that Motion Without Notice MM12.28 asks for a report to come to the Infrastructure and Environment Committee in July 2020 and that there is no urgency. Councillor Perks further stated that the Procedures By-law clearly spells out that the Clerk, in consultation with the Chair, has to make a determination about a Motion's urgency.
The City Clerk advised that the applicable part of section 8.4 of the Council Procedures is Part D, which refers to motions made during a Council meeting, and it requires that two-thirds of all Members vote in favour of the introduction, which happened.
Councillor Perks, rising on a Point of Order, stated that Part 8.4 D of the Council Procedures requires the Chair to agree the matter is urgent and asked the Speaker to explain why it is urgent that Council decides today if a report needs to go to the July 2020 meeting of the Infrastructure and Environment Committee.
Councillor Layton, rising on a Point of Order, stated that there is an Item that was deferred by the Infrastructure and Environment Committee on Congestion Management Plan – Update and how is it that Item MM12.28 doesn't require a reopening of Item IE9.6 or removal of that Item from Committee, given that it pertains to the effectiveness of the plan.
