The  Dangerous Dog Review Tribunal:

 

1.  Confirmed the determination of a dangerous dog, that the conditions of the order remain in effect, and that the Tribunal forward its decision and reasons to Roberta Manners and the Executive Director, Municipal Licensing and Standards on or before July 31, 2019.

Decision Advice and Other Information

On July 16, 2019, the Dangerous Dog Review Tribunal Panel was presented with a Dangerous Dog Order appeal. The Panel considered the documentation and oral arguments from the Applicant, Roberta Manners, the Designate of the  Executive Director, Municipal Licensing and Standards, the Animal Control Officer, James Konstantinidis, and the victim, Paul Romanuk.

 

The panel determined that a dangerous act occurred and was committed by the dog in question. Further it determined the Order was issued in accordance with the by-law. The offence was the second act on record. The panel concluded the current act was unprovoked and not in self defense. The dog lunged at the victim as the victim tried to pass on the sidewalk. The victim's injuries required medical treatment at a walk in clinic. The Applicant  agreed to the facts as stated by the witness, Paul Romanuk.

 

Based on the evidence and for the reasons above, the Panel confirms the determination of a Dangerous Dog.
