City Council Decision
City Council on June 26, 27, 28 and 29, 2018, adopted the following:
1. City Council adopt the confidential instructions to staff in Confidential Attachment 1 to the report (June 18, 2018) from the City Solicitor, as amended by Part 2 below.
2. City Council adopt the confidential instructions to staff in Confidential Attachment 1 to the supplementary report (June 25, 2018) from the City Solicitor.
3. City Council authorize the public release of the confidential instructions to staff in Confidential Attachment 1, as amended, and Confidential Appendices B and C to the report (June 18, 2018) from the City Solicitor and City Council direct that the balance of Confidential Attachment 1 and Confidential Appendix A to the report (June 18, 2018) from the City Solicitor remain confidential.
4. City Council authorize the public release of the confidential instructions to staff in Confidential Attachment 1 and Confidential Appendix A to the supplementary report (June 25, 2018) from the City Solicitor.
5. City Council direct that the balance of Confidential Attachment 1 to the supplementary report (June 25, 2018) from the City Solicitor remain confidential as it contains advice that is subject to solicitor-client privilege.
The confidential instructions to staff in Confidential Attachment 1 to the report (June 18, 2018) from the City Solicitor, as amended by Confidential Attachment 1 to the supplementary report (June 25, 2018) from the City Solicitor were adopted by City Council and are now public, as follows:
1. City Council accept the Settlement Offer terms set out in Confidential Appendix A to the supplementary report (June 25, 2018) from the City Solicitor.
2. City Council authorize the City Solicitor, and other appropriate staff, to attend the Local Planning Appeal Tribunal hearing in support of the Official Plan Amendment and Zoning By-law Amendment applications for 363-391 Yonge Street and 3 Gerrard Street East, as revised and described in the report (June 18, 2018) from the City Solicitor and in accordance with the settlement offer terms.
3. In the event that Local Planning Appeal Tribunal allows the appeals in whole or in part, City Council direct the City Solicitor to request the Local Planning Appeal Tribunal to withhold the issuance of its final order until the Official Plan Amendment and Zoning By-law Amendments are drafted to the satisfaction of the owner and the City and that the owner has entered into an agreement pursuant to Section 37 of the Planning Act, to be registered on title and to the satisfaction of the City Solicitor, to secure the matters as set out in the Settlement Offer terms and as described in the report June 18, 2018) from the City Solicitor.
Confidential Appendices B and C to Confidential Attachment 1 to the report (June 18, 2018) from the City Solicitor are now public and can be accessed under Background Information (City Council).
Confidential Appendix A to Confidential Attachment 1 to the supplementary report (June 25, 2018) from the City Solicitor is now public and can be accessed under Background Information (City Council).
The balance of Confidential Attachment 1 to the report (June 18, 2018) from the City Solicitor remains confidential in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice or communications that are subject to solicitor-client privilege.

Motions (City Council)
That in accordance with the provisions of Chapter 27, Council Procedures, City Council reconsider Item CC43.16.
That City Council adopt the following recommendations contained in the supplementary report (June 25, 2018) from the City Solicitor [CC43.16a]:
1. City Council adopt the confidential recommendations in Confidential Attachment 1.
2. City Council authorize the public release of the confidential recommendations in Confidential Attachment 1 and Confidential Appendix A, if adopted by City Council.
3. City Council direct that all other information contained in Confidential Attachment 1 is to remain confidential as it contains advice which is subject to solicitor-client privilege.
