CC39.9 - Request for Direction of Local Planning Appeal Tribunal Appeals of Official Plan Amendment 231 on Land Use Compatibility and Mitigation Issues

City Council Decision

City Council on April 24, 25, 26 and 27, 2018, adopted the following:

 

1.  City Council adopt the confidential instructions to staff in Confidential Attachment 1 to the supplementary report (April 25, 2018) from the City Solicitor.

 

2. City Council authorize the public release of:

 

i. the confidential instructions to staff in Confidential Attachment 1 to the supplementary report (April 25, 2018) from the City Solicitor and City Council direct that the balance of Confidential Attachment 1 to the supplementary report (April 25, 2018) from the City Solicitor remain confidential as it contains advice subject to solicitor-client privilege; and

 

ii. Confidential Attachment 2 to the supplementary report (April 25, 2018) from the City Solicitor.

 

3. City Council direct that Confidential Attachments 1, 2 and 3 to the report (April 16, 2018) from the City Solicitor remain confidential in their entirety.

  

The confidential instructions to staff in Confidential Attachment 1 to the supplementary report (April 25, 2018) from the City Solicitor were adopted by City Council and are now public, as follows:

 

1. City Council direct the City Solicitor and other Staff to attend at the Local Planning Appeal Tribunal in support of the modified settlement set out in Confidential Attachment 2 to the supplementary report (April 25, 2018) from the City Solicitor.

 

2. City Council direct the City Solicitor to continue negotiations with remaining appellants to the Land Use Compatibility and Mitigation phase of the Official Plan Amendment 231 hearing in an effort to resolve all outstanding issues under appeal and to take all necessary steps to bring resolution to the matter in consultation with the Chief Planner and Executive Director, City Planning.

 

Confidential Attachment 2 to the supplementary report (April 25, 2018) from the City Solicitor is now public and can be accessed under Background Information (City Council).

 

The balance of Confidential Attachment 1 to the supplementary report (April 25, 2018) from the City Solicitor remains confidential in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice that is subject to solicitor-client privilege.

 

Confidential Attachments 1, 2 and 3 to the report (April 16, 2018) from the City Solicitor remain confidential in their entirety in accordance with the provisions of the City of Toronto Act, 2006, as they pertain to litigation or potential litigation that affects the City or one of its agencies or corporations and they contain advice that is subject to solicitor-client privilege.

That City Council adopt the following recommendations contained in the supplementary report (April 25, 2018) from the City Solicitor [CC39.9a]:

 

1.  City Council delete the recommendations in Item CC39.9 and replace them with the following:

 

a.  City Council adopt the confidential instructions to staff in Confidential Attachment 1 to this supplemental report dated April 25, 2018.

 

b.  If the confidential instructions in Confidential Attachment 1 to this supplemental report dated April 25, 2018 are adopted, City Council authorize the public release of

 

i. the recommendations contained in Confidential Attachment 1 to this supplemental report, with the remainder of Confidential Attachment 1 to remain confidential, as it contains advice subject to solicitor-client privilege; and

 

ii. Confidential Attachment 2.

 

2.  Confidential Attachments 1, 2 and 3 to the City Solicitor's report dated April 16, 2018 remain confidential in their entirety.
