City Council Decision
City Council on March 26 and 27, 2018, adopted the following:
1. Council adopt the confidential recommendations in Confidential Attachment 1 to the report (March 16, 2018) from the City Solicitor.
2. City Council authorize the public release of the confidential recommendations in Confidential Attachment 1 and Confidential Appendices A and B to the report (March 16, 2018) from the City Solicitor and City Council direct that the balance of Confidential Attachment 1 to the report (March 16, 2018) from the City Solicitor remain confidential.
The confidential recommendations in Confidential Attachment 1 to the report (March 16, 2018) from the City Solicitor were adopted by City Council and are now public, as follows:
1. City Council authorize the City Solicitor to request that the Ontario Municipal Board make the following changes to Official Plan Amendment 289 in order to facilitate an Ontario Municipal Board settlement:
a. replace policy 2.2.7 (c) of Official Plan Amendment 289 with a new, stand-alone policy as follows:
The City and local School Boards, working in partnership, will ensure the provision of recreational and landscaped open space on existing, reconfigured or redeveloped school properties, including but not limited to those identified on Map 21-4, and pursue their greater utilization for community access through the development of shared-use open spaces and recreation facilities;
b. edit Policy 2.2.7 (b) as follows:
pursue opportunities arising from development to secure land for new parkland and improve existing parkland, including the parkland priority improvements identified in policy 2.30 2.28 and on Map 21-4;
c. replace the existing Map 21-4 with the Map attached as Confidential Appendix A to the report (March 16, 2018) from the City Solicitor; and
d. replace the existing Map 21-5 with the Map attached as Confidential Appendix B to the report (March 16, 2018) from the City Solicitor.
2. City Council authorize the City Solicitor and appropriate City Staff to attend at the Ontario Municipal Board hearing into this matter in support of the settlement.
The balance of Confidential Attachment 1 to the report (March 16, 2018) from the City Solicitor remains confidential in accordance with the provisions of the City of Toronto Act, 2006, as it pertains to litigation or potential litigation that affects the City or one of its agencies or corporations and it contains advice that is subject to solicitor-client privilege.
Confidential Appendices A and B to the report (March 16, 2018) from the City Solicitor are now public and can be accessed under Background Information (City Council).
