GM22.34 - 1797 St. Clair Avenue West Expropriation Settlement with Imperial Oil

City Council Decision

City Council on October 2, 3 and 4, 2017, adopted the following:

 

1.  City Council authorize the Chief Corporate Officer to pay Imperial Oil a limited sum over and above the funds already paid pursuant to the Offer of Compensation under section 25 of the Act, as a full and final settlement for the Ontario Municipal Board Compensation Claim in consequence of the expropriation of a portion of the property owned by Imperial Oil at 1797 St. Clair Avenue West, Toronto, being legally described as Part 1 on Expropriation Plan AT1797143 which settlement includes an all-in amount for market value, injurious affection, interest and costs as outlined in Confidential Attachment 1 to the report (September 8, 2017) from the Chief Corporate Officer and the General Manager, Transportation Services.

  

2.  City Council authorize the reallocation of funds within Transportation Services' Approved 2017 Capital Budget, in the amount set out in Confidential Attachment 1 to the report (September 8, 2017) from the Chief Corporate Officer and the General Manager, Transportation Services, from the St Clair TMP: Keele to Old Weston project (CTP815-59) to the St. Clair (Phase 2) project (CTP806-30).

 

3.  City Council authorize the Chief Corporate Officer and the General Manager, Transportation Services to enter into discussions with Imperial Oil to ensure clean up strategies and explore options for the acquisition of the balance of the site to accommodate the widening of St. Clair Avenue West, as contemplated through the St. Clair West SmartTrack Station and Transportation Master Plan, and City Council direct the Chief Corporate Officer and the General Manager, Transportation Services to report directly to the November 7, 8 and 9, 2017 meeting of Council on the status of those discussions.

 

4.  City Council authorize the public release of the information in Confidential Attachment 1 to the report (September 8, 2017) from the Chief Corporate Officer and the General Manager, Transportation Services following the payment of the settlement amount.

 

Confidential Attachment 1 to the report (September 8, 2017) from the Chief Corporate Officer and the General Manager, Transportation Services remains confidential in its entirety at this time, in accordance with the City of Toronto Act, 2006, as it pertains to a proposed or pending acquisition or sale of land for municipal or local board purposes.  Confidential Attachment 1 to the report (September 8, 2017) from the Chief Corporate Officer and the General Manager, Transportation Services will be made public following the payment of the settlement amount.
