Item - 2016.CC19.12

City Council on June 7, 8 and 9, 2016, adopted the following:

1.  City Council adopt the confidential recommendations contained in Confidential Attachment 1 to the report (June 6, 2016) from the Interim City Solicitor.

2.  City Council authorize the public release of the confidential recommendations contained in Confidential Attachment 1 to the report (June 6, 2016) from the Interim City Solicitor.

3.  City Council authorize the public release of Confidential Appendices 1 and 2 to Confidential Attachment 1 to the report (June 6, 2016) from the Interim City Solicitor.

4.  City Council authorize the public release of Confidential Appendix 3 to Confidential Attachment 1 to the report (June 6, 2016) from the Interim City Solicitor.

5.  City Council direct that except as provided in Parts 2, 3 and 4 above, the balance of Confidential Attachment 1 to the report (June 6, 2016) from the Interim City Solicitor remain confidential.

The following confidential recommendations contained in Confidential Attachment 1 to the report (June 6, 2016) from the Interim City Solicitor were adopted by City Council and are now public:

1.  City Council authorize the City Solicitor in consultation with the Chief Planner and Executive Director, City Planning to enter into Minutes of Settlement with KingSett Capital Inc. (KingSett), the Church Wellesley Neighbourhood Association and the Bay Cloverhill Community Association  as a partial settlement of KingSett Capital Inc.'s appeal respecting the Phase I Hearing, substantially in accordance with the Phase I Settlement Principles for KingSett set forth in Confidential Appendix 2 to Confidential Attachment 1 to the report (June 6, 2016) from the Interim City Solicitor, all in a form satisfactory to the City Solicitor and the Chief Planner and Executive Director, City Planning as a partial settlement of KingSett's general appeal to Official Plan Amendment 183 (By-law 1507-2013).

2.  City Council authorize the City Solicitor and the Chief Planner and Executive Director, City Planning to attend before the Ontario Municipal Board for the June 21, 2016 'Settlement Hearing' in support of modifications to Official Plan Amendment 183 (By-law 1507-2013) substantially as set out in Confidential Appendix 3 to Confidential Attachment 1 to the report (June 6, 2016) from the Interim City Solicitor and all in a form satisfactory to the City Solicitor and the Chief Planner and Executive Director, City Planning, and subject to such revisions as are acceptable to both the Chief Planner and Executive Director, City Planning and the City Solicitor.

3.  City Council authorize the Director, Toronto and East York District, City Planning to continue to work toward settlement of outstanding issues in connection with the appeals being considered at the Phase I hearing of OPA 183 in a manner that meets  the objectives and maintains the intent and purpose of OPA 183, all to the satisfaction of the Chief Planner and Executive Director, City Planning, in consultation with the City Solicitor, and further, to authorize the City Solicitor and appropriate staff to attend at the Ontario Municipal Board in support of the same.

4.  City Council authorize the City Solicitor to make technical and stylistic changes as may be required to the modifications to OPA 183 as set out in Appendix 3 of Confidential Attachment 1 to the report (June 6, 2016) from the Interim City Solicitor.

Confidential Appendices 1, 2 and 3 to Confidential Attachment 1 to the report (June 6, 2016) from the Interim City Solicitor are now public and can be accessed under Background Information (City Council).

The balance of Confidential Attachment 1 to the report (June 6, 2016) from the Interim City Solicitor remains confidential in accordance with the provisions of the City of Toronto Act, 2006, as it pertains to litigation that affects the City or one of its agencies, boards and commissions and it contains advice or communications that are subject to solicitor-client privilege.
