City Council Decision

City Council on February 3 and 4, 2016, adopted the following:

 

1.  City Council adopt the confidential instructions to staff in Confidential Attachment 2 to the report (January 28, 2016) from the City Solicitor, and City Council authorize the public release of the confidential instructions with the balance of Confidential Attachment 2 to the report (January 28, 2016) from the City Solicitor to remain confidential.

 

The following confidential instructions to staff contained in Confidential Attachment 2 to the report (January 28, 2016) from the City Solicitor were adopted by City Council and are now public:

 

1.  City Council direct the City Solicitor and appropriate staff to attend at the Ontario Municipal Board hearing to oppose the revised proposal as submitted by the owner on January 26, 2016 for the site at 200 St. Clair Avenue West.

 

2.  City Council direct the City Solicitor to advise the Ontario Municipal Board that City Council’s position is that any redevelopment of the site, if approved by the Ontario Municipal Board, should:

 

a.  secure services, facilities or matters pursuant to Section 37 of the Planning Act, as may be required by the Chief Planner and Executive Director, City Planning, (which, in the event the Ontario Municipal Board approves the revised proposal, would be the payment of $250,000.00 offered by the owner); and

 

b.  satisfy the Chief Planner and Executive Director, City Planning with respect to site plan matters, including the approval of plans and drawings and site plan conditions.

 

3.  City Council authorize the City Solicitor and City staff to take any necessary steps to implement City Council's decision.

 

The balance of Confidential Attachment 2 to the report (January 28, 2016) from the City Solicitor remains confidential in accordance with the provisions of the City of Toronto Act, 2006, as it pertains to litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board and advice or communications that are subject to solicitor-client privilege.
