City Council Decision
City Council on November 8 and 9, 2016, adopted the following:
1. City Council, in light of the information provided in the supplementary report (November 8, 2016) from the City Manager, receive the report (October 24, 2016) from the Auditor General for information.
2. City Council adopt the confidential recommendation contained in Confidential Attachment 1 to the supplementary report (November 8, 2016) from the City Manager.
3. City Council direct that the following confidential documents remain confidential in their entirety as they relate to a proposed or pending land acquisition by the City or one of its agencies and corporations:
a. Confidential Attachment 1 to the report (October 24, 2016) from the Auditor General;
b. Confidential Attachment 1 to the letter (October 27, 2016) from the Board of Directors, Toronto Parking Authority;
c. Confidential letter (October 28, 2016) from the Audit Committee; and
d. Confidential Attachment 1 to the supplementary report (November 8, 2016) from the City Manager.
The following confidential documents remain confidential in their entirety in accordance with the provisions of the City of Toronto Act, 2006, as they relate to a proposed or pending land acquisition by the City or one of its agencies and corporations:
a. Confidential Attachment 1 to the report (October 24, 2016) from the Auditor General;
b. Confidential Attachment 1 to the letter (October 27, 2016) from the Board of Directors, Toronto Parking Authority;
c. Confidential letter (October 28, 2016) from the Audit Committee; and
d. Confidential Attachment 1 to the supplementary report (November 8, 2016) from the City Manager.

Motions (City Council)
That City Council delete Audit Committee Recommendations 1 and 2:
1. City Council request the Toronto Parking Authority to implement the Auditor General's confidential recommendations contained in Confidential Attachment 1 to the report (October 24, 2016) from the Auditor General.
2. City Council adopt the confidential instructions to the Board of Directors, Toronto Parking Authority, contained in the Confidential letter (October 28, 2016) from the Audit Committee.
and adopt instead the following recommendations contained in the supplementary report (November 8, 2016) from the City Manager [AU7.14b]:
1. City Council, in light of the information provided in the supplementary report (November 8, 2016) from the City Manager, receive the report (October 24, 2016) of the Auditor-General for information.
2. City Council adopt the confidential recommendation contained in Confidential Attachment 1 to the supplementary report (November 8, 2016) from the City Manager.
3. City Council direct that the confidential information contained in Confidential Attachment 1 to the supplementary report (November 8, 2016) from the City Manager remain confidential in its entirety as it relates to a proposed or pending land acquisition by the City or one of its agencies and corporations.

Committee Recommendations
The Audit Committee recommends that:
1. City Council request the Toronto Parking Authority to implement the Auditor General's confidential recommendations contained in Confidential Attachment 1 to the report (October 24, 2016) from the Auditor General.

The Audit Committee requested the City Manager to report directly to City Council for its meeting on November 8, 2016, on the necessity and merits of proceeding with this transaction.
The Audit Committee recessed its public session and met in closed session to consider confidential information on this Item as it relates to a proposed or pending land acquisition by the City or one of its agencies and corporations. The Audit Committee recommended to City Council, confidential instructions to the Board of Directors, Toronto Parking Authority.

Summary
The Auditor General was contacted and requested to review a pending property acquisition at Finch Avenue West and Arrow Road by the Toronto Parking Authority (TPA).
The Auditor General has submitted a report to the Board of Directors of the Toronto Parking Authority that focused on one aspect of this acquisition. There are several other matters still being reviewed in relation to this transaction. The Auditor General will provide a full report to the Board and to Council through the Audit Committee when her review of this transaction is complete.

The Audit Committee recessed its public session and met in closed session to consider the above matter.
The Audit Committee reconvened in public session at 1:12 p.m. Councillor Lee took the Chair and advised that the Committee had completed its closed session consideration of confidential information related to this Item. The Audit Committee recommended to City Council, confidential instructions to the Board of Directors, Toronto Parking Authority. The Audit Committee would now proceed with the public debate on this Item.
That the Audit Committee request the City Manager to report directly to City Council for its meeting on November 8, 2016, on the necessity and merits of proceeding with this transaction.

The Board of Directors of the Toronto Parking Authority, at their special meeting of October 26, 2016, considered a report entitled, “Auditor General’s Observations of a Land Acquisition at Finch Avenue West and Arrow Road by the Toronto Parking Authority”, and passed the following motions:
1. Receive the report of the Auditor General dated October 24, 2016.
2. Adopt recommendations numbered 1. through 3. contained in the public Audit Report from the City of Toronto Auditor General’s Office: “Auditor General’s Observations of a Land Acquisition at Finch Avenue West and Arrow Road by the Toronto Parking Authority” dated October 24, 2016.
3. Approve the attached confidential amended motions as noted in Confidential Attachment #1.
4. Thank the Auditor General for presenting the report and attending the Toronto Parking Authority’s special Board meeting of October 26, 2016 to answer questions from the Board.
5. Direct that the attached report dated October 24, 2016 from the Auditor General be forwarded to the Committee Administrator for inclusion in the Audit Committee agenda for its meeting of October 28, 2016.
