EX4.13 - Ticketing of Vehicles During Pick-up and Drop-off of Persons with Disabilities

City Council Decision

City Council on March 31, April 1 and 2, 2015, adopted the following:

1.  City Council direct the General Manager, Transportation Services, in consultation with the Toronto Police Service, to review the current by-law provisions.
 
2.  City Council request the Toronto Police Services Board to establish a protocol to ensure that individuals providing transportation services to persons with disabilities are not ticketed with a parking offence when actively engaged in pick up and/or drop off activities while away from the vehicle.
 
3.  City Council request that reports be submitted to the Executive Committee at its meeting on May 26, 2015 on the results of the reviews in Parts 1 and 2 above.

That City Council delete the Executive Committee recommendation:

 

Recommendation to be deleted:

 

1. City Council request the Toronto Police Service to consider using discretion when issuing parking tickets to vehicles picking up and/or dropping off a person with a disability.

 

and adopt instead the following new recommendations:

 

1. City Council direct the General Manager, Transportation Services, in consultation with Toronto Police Service, to review the current by-law provisions.

Councillor Ainslie, rising on a Point of Order, asked the Speaker to rule on whether motion 1 by Councillor Fragedakis was in order, as it pertains to the request of staff.

Ruling by Speaker Frances Nunziata
Speaker Nunziata accepted the Point of Order and ruled that Councillor Fragedakis should review the motion with staff. Councillor Fragedakis subsequently revised her motion.

Councillor Fragedakis, rising on a Point of Privilege, stated that Councillor Robinson had commented on whether Councillor Fragedakis was aware of the Mayor's efforts in this matter. Councillor Fragedakis stated that she was aware of those efforts.
