City Council on October 8, 9, 10 and 11, 2013, referred Item TE26.34 together with the following motions to the Deputy City Manager, Cluster B for further consideration:

1. That City Council amend Toronto East York Community Council Recommendation 1 by deleting all words following the word "signage" and inserting the words "placed at a location at or near the original locations on Yonge Street or Gould Street, satisfactory to City Council and on terms satisfactory to the Chief Planner, in consultation with the Ward Councillor, the Chief Building Official and the City Solicitor, in order to continue the rich history and legacy of Sam The Record Man to Toronto’s history and music heritage, subject to:
i. the Commemoration Plan substantially in accordance with plans and drawings prepared by Zeidler Partnership/Snohetta dated, July 3, 2013, on-line recognition of Sam the Record Man on Yonge Street and full documentation of the salvaged neon signs being financially secured in an Amending Site Plan Agreement registered against title to 341, 347 and 349 Yonge Street."
so that it now reads as follows:
1. City Council direct that the Easement Agreements between the City and Ryerson University, registered as Instruments Nos. AT1868230, AT1868231 and AT1868232 be amended, released from title, and/or new agreements entered into, as may be appropriate in the opinion of the City Solicitor, to secure the restoration and installation of the neon signage placed at a location at or near the original locations on Yonge Street or Gould Street, satisfactory to City Council and on terms satisfactory to the Chief Planner, in consultation with the Ward Councillor, the Chief Building Official and the City Solicitor, in order to continue the rich history and legacy of Sam The Record Man to Toronto’s history and music heritage, subject to:
i. the Commemoration Plan substantially in accordance with plans and drawings prepared by Zeidler Partnership/Snohetta dated, July 3, 2013, on-line recognition of Sam the Record Man on Yonge Street and full documentation of the salvaged neon signs being financially secured in an Amending Site Plan Agreement registered against title to 341, 347 and 349 Yonge Street.
2. City Council amend Toronto East York Community Council Recommendation 2 by deleting the words "Toronto East York Community Council" and inserting the words "City Council" so that it now reads as follows:

Community Council Recommendations
The Toronto and East York Community Council recommends that:
1. City Council direct that the Easement Agreements between the City and Ryerson University, registered as Instruments Nos. Summary
This report recommends approval, with conditions, of an amendment to Agreements between Ryerson University (“Ryerson”) and the City of Toronto (the “City”) for the properties located at 347 and 349 Yonge Street, the former location of the Sam the Record Man flagship store between 1961 and 2007.
Ryerson proposes to delete from title the Easement Agreements dated August 15, 2008 and to revise their existing Site Plan Agreement with the City for the Student Learning Centre at 341, 347 and 349 Yonge Street in order to secure the recognition and commemoration of the original Sam the Record Man flagship store and associated neon signage.
