City Council Decision

City Council on October 2, 3 and 4, 2012, adopted the following:

 

1.         City Council authorize and direct the appropriate City officials to:

 

a.         amend City of Toronto Municipal Code Chapter 886 (Footpaths, Pedestrian Ways, Bicycle Paths and Bicycle Lanes) to introduce a new definition and a new schedule for "Cycle Tracks," to regulate permitted and prohibited usage of cycle tracks and to incorporate regulations for cyclists in a cycle track approaching a TTC bus which is stopped for the purpose of taking on or discharging passengers, all as generally described in Appendix 2 of the report (August 20, 2012) from the Acting General Manager, Transportation Services;

 

b.         establish a fixed fine amount of $150.00 for any new parking, standing, and stopping offences created by Part 1a above; and

 

c.         make application to the Senior Regional Justice of the Ontario Court of Justice to establish the set fines and that the amounts requested for new parking/standing/ stopping offences created as a result of  Part 1a above be equal to the fixed fine amounts as outlined in Part 1b above.

 

2.         City Council approve amendments to City of Toronto Municipal Code Chapter 886 (Footpaths, Pedestrian Ways, Bicycle Paths and Bicycle Lanes) to delete Sherbourne Street, from Front Street East to 70 metres south of Bloor Street East, from Schedule D to Chapter 886, Designated Bicycle Lanes, and to add the same section of Sherbourne Street to the new Cycle Tracks Schedule, as detailed in Appendix 3 of the report (August 20, 2012) from the Acting General Manager, Transportation Services.

 

3.         City Council approve the highway alterations to widen the travelled portion of the road at the following locations to allow for the installation of lay-bys to accommodate Wheel-Trans vehicles, car and taxi passenger pick-up/drop-off, and a taxi stand, as identified in Appendices 4A to 4E of the report (August 20, 2012) from the Acting General Manager, Transportation Services:

 

a.          Sherbourne Street, east side, from a point 12.0 metres north of Isabella Street to a point 35.0 metres further north;

 

b.          Sherbourne Street, west side, from a point 168.2 metres north of Carlton Street to a point 31.0 metres further north; Sherbourne Street, east side, from a point 118.0 metres north of Carlton Street to a point 35.0 metres further north to provide a designated Taxi stand;

 

c.          Sherbourne Street, west side, from a point 62.4 metres south of Gerrard Street East to a point 31.0 metres further south;

 

d.          Sherbourne Street, east side, from a point 113.9 metres north of Dundas Street East to a point 31.0 metres further north; and

 

e.          Sherbourne Street, east side, from a point 55.9 metres south of Shuter Street to a point 27.0 metres further south.

 

4.         City Council approve amendments to the parking, standing and stopping and taxi cab regulations on both sides of Sherbourne Street, between Queen Street East and Bloor Street East, and detailed in Appendix 5 of the report (August 20, 2012) from the Acting General Manager, Transportation Services.

 

5.         City Council approve the amendments to the parking regulations to extend the permit parking limit and to add pay-and-display parking spaces on Earl Street, between Huntley Street and Sherbourne Street, and to add pay-and-display parking spaces on Adelaide Street East, between Sherbourne Street and Berkeley Street, all as detailed in Appendix 5 of the report (August 20, 2012) from the Acting General Manager, Transportation Services.

 

6.         City Council enact northbound and southbound left turn prohibitions on Sherbourne Street at both King Street East and Shuter Street, from 7:00 a.m. to 9:00 a.m. and from 4:00 p.m. to 6:00 p.m., Monday to Friday, as detailed in Appendix 5 of the report (August 20, 2012) from the Acting General Manager, Transportation Services.

 

7.         City Council enact "Right Turn on Red" prohibitions at the following locations and in the directions indicated:

 

a.         eastbound and westbound from Shuter Street onto Sherbourne Street;

 

b.         eastbound and westbound from Gerrard Street East onto Sherbourne Street; and

 

c.         eastbound and westbound from Wellesley Street East onto Sherbourne Street.

 

8.         In co-ordinating the removal of the Jarvis Street Bicycle Lanes with the Sherbourne Street Cycle Track, City Council direct that the necessary funds to remove the bike lanes on Jarvis Street be funded from within the approved Transportation Budget and not the Cycling Budget.

 

9.         City Council direct the Acting General Manager, Transportation Services to report to the Public Works and Infrastructure Committee in Fall 2013 on:

 

a           the volume of cyclists using the Sherbourne Street Cycle Track;

 

b.         operational and safety issues related to the installation of the Cycle Track on Sherbourne Street, including winter maintenance; and

 

c.         the extent of compliance of the cycle track regulations and any enforcement-related issues.

 

10.       City Council authorize and direct the appropriate City officials to take the necessary action to give effect to Parts 1 to 7 above, including the introduction of all necessary Bills.

Committee Recommendations

The Public Works and Infrastructure Committee recommends that:

 

1.         City Council authorize and direct the appropriate City officials to:

 

a.         amend City of Toronto Municipal Code Chapter 886 (Footpaths, Pedestrian Ways, Bicycle Paths and Bicycle Lanes) to introduce a new definition and a new schedule for "Cycle Tracks," to regulate permitted and prohibited usage of cycle tracks and to incorporate regulations for cyclists in a cycle track approaching a TTC bus which is stopped for the purpose of taking on or discharging passengers, all as generally described in Appendix 2 of the report dated August 20, 2012 from the Acting General Manager, Transportation Services;

2.         City Council approve amendments to City of Toronto Municipal Code Chapter 886 (Footpaths, Pedestrian Ways, Bicycle Paths and Bicycle Lanes) to delete Sherbourne Street, from Front Street East to 70 metres south of Bloor Street East, from Schedule D to Chapter 886, Designated Bicycle Lanes, and to add the same section of Sherbourne Street to the new Cycle Tracks Schedule, as detailed in Appendix 3 of the report dated August 20, 2012 from the Acting General Manager, Transportation Services.

Summary

City Council, at its meeting of July 12, 13 and 14, 2011, directed Transportation Services to proceed with the detailed design and consultation process for separated bicycle lanes on Sherbourne Street with a view to implementing them in 2012. The design and consultation process has resulted in a raised cycle track design from Front Street East to Gerrard Street East and a street-level cycle track design from Gerrard Street East to just south of Bloor Street East. The operating requirements for cycle tracks are different than for traditional painted bicycle lanes and, as a result, a new definition and schedule for cycle tracks needs to be added in the Municipal Code Chapter 886 (Footpaths, Pedestrian Ways, Bicycle Paths and Bicycle Lanes). This report also seeks Council authority to amend the appropriate City by-laws required for the new cycle track design on Sherbourne Street.

 

The new design involves the removal of all on-street parking on Sherbourne Street between Queen Street East and Bloor Street East; introduction of six lay-bys to accommodate Wheel-Trans, pick-up/drop-off activity and a taxi stand; and peak-hour left turn restrictions at the King Street East and Shuter Street intersections. To mitigate the impact of the removal of parking on Sherbourne Street, 20 new parking spaces are being added to east-west streets intersecting Sherbourne Street.

 

The construction of the Sherbourne Street cycle tracks, from King Street East to Bloor Street East, began in August 2012 and will be completed in two phases. The section from Gerrard Street East to Bloor Street East is scheduled to be completed by mid-October and the section from King Street East to Gerrard Street East by mid-November 2012.

 

Due to the construction of a new building at 101 Sherbourne Street, the road resurfacing between Front Street East and King Street East cannot be completed in 2012. Therefore, the cycle tracks in this section have been deferred to 2013. Cycle track construction between Lake Shore Boulevard East and Front Street East is scheduled for 2014, to be coordinated with the reconstruction of Sherbourne Street in this section.
