City Council Decision
City Council on October 30, 31 and November 1, 2012, adopted the following:
1. City Council appoint the candidates listed in Confidential Attachment 1 to the Toronto Transit Commission Board, at the pleasure of Council, for a term of office ending on November 30, 2014 and until successors are appointed.
2. City Council authorize the City Clerk to make the appointees' names public once appointed by Council and the appointees have been notified.
3. City Council identify the candidates listed in Confidential Attachment 2 as alternates for the Civic Appointments Committee to consider for appointment, in the order listed, should a vacancy occur during the term.
4. City Council direct that the names of the candidates identified as alternates remain confidential until appointed as a member, as required under the Public Appointments Policy.
City Council has appointed the following persons to the Toronto Transit Commission Board:
- Maureen Adamson
- Nick Di Donato
- Alan Milliken Heisey
- Anju Kumar Virmani.
Confidential Attachment 2 remains confidential in its entirety in accordance with the provisions of the City of Toronto Act, 2006, as it contains personal information about identifiable persons. The alternates' names will be made public if appointed to the Toronto Transit Commission Board.
City Council Decision Advice and Other Information
City Council recessed its public session and met as Committee of the Whole in closed session on October 30, 2012, and considered confidential information on this Item as it relates to personal information about identifiable individuals being considered for appointment to the Toronto Transit Commission Board.
On October 30, 2012, the following Members of Council nominated public members for appointment to the Toronto Transit Commission:
a. Councillor Joe Mihevc moved that Applicant #34 be appointed to the Toronto Transit Commission Board.
b. Councillor Anthony Perruzza moved that Applicant #267 be appointed to the Toronto Transit Board.
There being six (6) candidates for four (4) positions, City Council conducted a ballot for the appointment of four (4) public members to the Toronto Transit Commission Board.
The Speaker asked the City Clerk to instruct the Members on the balloting process.
The City Clerk advised Members of Council as follows:
"We will now proceed to the balloting for public members of the Toronto Transit Commission.
There are four positions to elect.
It requires a majority of ballots cast to be elected to one of the positions. Any candidate receiving a majority of ballots cast will be declared elected.
If fewer than four people receive a majority of votes on the first ballot, Council will conduct a second ballot for the remaining positions with the remaining candidates. On a second ballot, only those declared elected are removed from consideration. All other candidates are still eligible.
We are about to distribute the ballots to you.
The ballots contain four blank spaces. Please indicate your vote by printing the number of a candidate in the space provided.
Please print clearly and legibly. If I cannot determine your intention for any reason, including your handwriting, any votes in dispute will not be counted.
You may vote for up to and including four people.
If you vote for more than four people, your ballot will be spoiled, and none of your votes will be counted.
Please write the number of the candidate, not the name. If you write the name your ballot will be spoiled and not counted.
Secret ballots are prohibited by law. You must print your name and sign your ballot in the space provided. If you do not, your ballot will be spoiled, and none of your votes will be counted.
You must remain seated during the voting process until all ballots have been collected.
When you are finished voting, please fold your ballot in half and place it on the ledge in front of your desk for collection. We will collect the ballots when all Members have finished voting.
Members, the voting process is about to begin. Please take your seats and remain seated during the voting process.
We will now distribute the ballots."
The City Clerk distributed the ballots to the Members of Council. Once all ballots had been cast and collected, the City Clerk tallied the results of the ballot.
The City Clerk announced the results of the ballot for the appointment of four (4) public members to the Toronto Transit Commission Board conducted on Tuesday, October 30, 2012, as follows:
- Number of ballots cast: 39
- Number of votes required to elect for each of the four positions: 20
- There were no spoiled or illegal ballots
- For Candidate 3: 31 votes
- For Candidate 34: 16 votes
- For Candidate 110: 24 votes
- For Candidate 161: 36 votes
- For Candidate 267: 9 votes
- For Candidate 384: 34 votes
The City Clerk declared the following candidates elected, each having received a majority of ballots cast:
- Candidate 3
- Candidate 110
- Candidate 161
- Candidate 384.
Since four public members were elected, no further ballots were required.

Motions
Councillor Mammoliti, rising on a Point of Privilege, stated that he had concerns about the length of the day and the lack of notice provided to Committee members; that he had personal responsibilities which precluded him from staying for the entire meeting; and that he would be moving motions to change the format of the day.
Chair Nunziata accepted Councillor Mammoliti's Point of Privilege.
Councillor Mammoliti proposed that the Civic Appointments Committee:
i. adjourn the meeting no later than 5:15 p.m.; and
ii. request the Clerk to contact the remaining candidates to cancel their interviews for today and to reschedule those interviews to another date.
