CC13.6 - East Bayfront - Partial Settlement of Appeals of By-law 1049-2006 - Environmental Issues

City Council Decision

City Council on October 24 and 25, 2011, adopted the following:

 

1.         City Council adopt the confidential instructions to staff in Confidential Attachment 1 to the report (October 17, 2011) from the City Solicitor and the Chief Planner and Executive Director, City Planning.

 

2.         City Council authorize the public release of the recommendations approved by City Council together with Confidential Attachment 2 to the report (October 17, 2011) from the City Solicitor and the Chief Planner and Executive Director, City Planning after Council's approval and the balance of the information remain confidential.

 

The following instructions have been adopted by City Council and are now public:

 

1.         City Council authorize the City Solicitor to take any necessary actions to finalize and give effect at the ongoing Ontario Municipal Board hearing to a settlement substantially in accordance with the Draft Minutes of Settlement attached as Attachment 3 to the report (October 17, 2011) from the City Solicitor and the Chief Planner and Executive Director, City Planning Division, and on such additional or modified terms as are satisfactory to the Chief Planner and Executive Director, City Planning Division and City Solicitor.

 

2.         City Council authorize the City Solicitor to request the Ontario Municipal Board to modify the Central Waterfront Secondary Plan and East Bayfront Zoning Bylaw 1049-2006 as necessary to give effect to the final form of settlement to be presented to the OMB.

 

3.         City Council authorize the City Solicitor and other appropriate City Officials to execute Minutes of Settlement and any related documentation including necessary agreements in a form satisfactory to the City Solicitor to give effect to Council's decision.

 

Confidential Attachment 2 (Map) and Confidential Attachment 3 (Minutes of Settlement) to the report (October 17, 2011) from the City Solicitor and the Chief Planner and Executive Director, City Planning Division are also now public and can be accessed below under Background Information (City Council).

 

The balance of Confidential Attachment 1 to the report (October 17, 2011) from the City Solicitor and the Chief Planner and Executive Director, City Planning Division remains confidential in accordance with the provisions of the City of Toronto Act, 2006, as it relates to a litigation matter before the Ontario Municipal Board on the East Bayfront-West Precinct Zoning By-law (By-law No. 1049-2006).
