City Council Decision Advice and Other Information
October 24, 2011:
Speaker Nunziata, during the morning session of the meeting, invited City Manager Joe Pennachetti forward to recognize City Solicitor Anna Kinastowski on winning the International Municipal Lawyers Association (IMLA) Bruce A. Noble Award. The Award honours an outstanding Canadian lawyer for excellence, dedication, and service to the practice of Canadian municipal law. Speaker Nunziata then called upon Mayor Ford to present Ms. Kinastowski with a scroll.
Speaker Nunziata, during the morning session of the meeting, welcomed two groups of Grade 5 students from the Humberwood Downs Junior Middle Academy, who were in attendance to learn more about municipal government.
Mayor Ford, during the afternoon session of the meeting, welcomed Mayor Bob Bratina from the City of Hamilton, who presented Mayor Ford with a Hamilton Tigercats football jersey to wear during the Council meeting, since the Hamilton Tigercats had defeated the Toronto Argonauts over the weekend. Mayor Ford congratulated Mayor Bratina on the win.
Speaker Nunziata, during the afternoon session of the meeting, welcomed the Grade 10 students from Father Henry Carr Secondary School, who were in attendance to learn more about municipal government.
Councillor Fragedakis, during the afternoon session of the meeting, addressed City Council to encourage Members to view the exhibit in the rotunda titled "Hellenic Monuments Time has not Erased". The exhibit gives visitors a taste of two centuries of Hellenic-Canadian life in Toronto and is part of Imathiotika 2011 under the auspices of the World Council of Hellenes Abroad, the Greek Community of Toronto, Consul General of Greece and the Pan-Macedonian Association of Toronto. Councillor Fragedakis introduced Jim Karas, President of the Pan-Macedonian Association of Toronto, Michael Mouratidis, the event curator, and Lia Overs, one of the event hosts, and asked Council to recognize them and welcome them to the Chamber.
October 25, 2011:
Speaker Nunziata, during the morning session of the meeting, called upon Mayor Ford to come forward to recognize Toronto Police Service and Toronto Fire Services staff for their achievements at the World Police and Fire Games held in New York City this year. Mayor Ford congratulated several of the medalists who were present in the Chamber.
Councillor McMahon, during the morning session of the meeting, addressed City Council to acknowledge that today is the one year anniversary of the election of this City Council, and wished everyone a Happy Anniversary.
Speaker Nunziata, during the morning session of the meeting, welcomed a delegation of visitors from the People's Republic of China, Ministry of Supervision, who were in attendance to learn more about municipal government.

EX11.5 - Administrative Amendments to Reserve Fund Accounts

City Council on October 24 and 25, 2011, adopted the following:
1. City Council direct that an obligatory reserve fund account called the ‘Transit Expansion Reserve Fund’ be established to act as a repository for advanced funds received from Metrolinx for reimbursement of transit expansion project costs managed by the TTC and paid to entitled parties by the TTC on behalf of Metrolinx with criteria as set out in Appendix 1 of the report (September 15, 2011) from the Deputy City Manager and Chief Financial Officer.
2. City Council direct that Investment earnings be allocated to the account created in Part 1 above, based the earlier of the receipt of funds or January 1, 2011 whichever is the more recent.
3. City Council direct that an obligatory reserve fund account called the ‘Off-site Parkland Dedication Reserve Fund’ be established to hold funds for parkland acquisitions that arise from the provisions of development agreements with criteria as set out in Appendix 2 of the report (September 15, 2011) from the Deputy City Manager and Chief Financial Officer.
4. City Council direct that the contribution policy of the Sony Centre Facility Fee Reserve Fund be amended to be: The funding of the account shall be from the implementation of a surcharge on ticket sales at the theatre as shall be determined by the Board of Directors of the Sony Centre in an amount to be determined from time to time; amounts received from salvage; developer capital contributions; naming rights capital contributions; other recoveries of a capital nature; and other contributions of a capital nature as directed by City Council.
5. City Council direct that, starting in 2011 funds received from the Province from the Emergency Response Unit be deposited in the EMS Vehicle Replacement Reserve and funds in the amount of $827,725.93 be transferred from the EMS Equipment Replacement Reserve (XQ1019) to the EMS Vehicle Replacement Reserve (XQ1018) – this being the remaining balance of Provincial funds in the Equipment account.
6. CityCouncil direct that the funds in the Public Access Defibrillation Reserve be transferred to Vehicle Reserve – EMS Equipment.
7. City Council direct that the funds in the Endowment for the Programming at the Toronto Music Garden Reserve Fund be transferred to a new trust account for the Programming at the Music Garden and the funds be invested for a period which would yield $25,000 per annum or 10 years whichever is the lesser.
8. City Council direct that the funds in the Gordon Sinclair Scholarship Reserve Fund and the Gordon Sinclair Trust be donated to the Journalism School at Ryerson University and that the City Manager be authorized to enter into whatever agreements are necessary with Ryerson University to give effect to this.
9. City Council direct that the funds in the WWII 50th Anniversary Memorial, Other Memorials & Monuments Reserve be transferred to the WWII 50th Anniversary Memorial Maintenance Reserve.

City Council on October 24 and 25, 2011, adopted the following:
1. City Council grant authority to the Deputy City Manager and Chief Financial Officer to negotiate a municipal capital facility agreement with TCHC to secure the ongoing affordability of the rental housing units identified in Schedule "A" of the report (September 19, 2011) from the Deputy City Manager and Chief Financial Officer, and for the affordable housing portion of units of the premises identified in Schedule B of the report( September 19, 2011) from the Deputy City Manager and Chief Financial Officer, on such terms and conditions as the Deputy City Manager and Chief Financial Officer considers appropriate, and in a form satisfactory to the City Solicitor.
2. City Council pass a by-law pursuant to section 252 of the City of Toronto Act, 2006, and the City's Municipal Housing Facility By-law (By-law No. 282-2002) providing authority to:
a. Enter into a municipal capital facility agreement with Toronto Community Housing Corporation (TCHC) for the premises identified and described in Schedule "A" of this report, and for the affordable housing portion of units of the premises identified in Schedule "B" of the report (September 19, 2011) from the Deputy City Manager and Chief Financial Officer, on such terms as have been negotiated pursuant to Part 2; and
b. Exempt the premises or portions of premises described in Recommendation 2a. above from municipal and education property taxation, which tax exemption is to be effective from the latter of January 1, 2012, the date the tax exemption by-law comes into force, and the date the municipal capital facility agreement is signed.
3. City Council authorize the Deputy City Manager and Chief Financial Officer to report directly to Council at its meeting of October 24-25, 2011, on any technical amendments to the properties identified in Schedule "A" and Schedule "B" of the report (September 19, 2011) from the Deputy City Manager and Chief Financial Officer, if necessary.
4. City Council direct the City Clerk to give written notice of the by-law to the Ministers of Finance, Education and Municipal Affairs and Housing, the Municipal Property Assessment Corporation, the Toronto District School Board, the Toronto Catholic District School Board, the Conseil Scolaire de District du Centre-Sud-Ouest, and the Conseil Scolaire de District du Catholique Centre-Sud.
5. City Council direct the General Manager, Shelter, Support and Housing Administration:
a. To reduce the annual subsidy provided by the City to TCHC by the amount of municipal property tax savings to TCHC generated through the property tax exemption recommended by this report, to ensure that there is no net impact on the City's operating budget;
b. To make the necessary amendments to the Operating Agreement between the City and TCHC pursuant to clause 7.3.2 of the City's Shareholder Direction to TCHC to give effect thereto; and
c. In consultation with the Deputy City Manager and Chief Financial Officer, to report through the First Quarter Operating Variance Report, once the final impacts have been confirmed, on the necessary budget adjustments to the 2012 Approved Operating Budget for Shelter, Support and Housing Administration and to the Non Program Accounts.
6. City Council request TCHC to provide a funding plan satisfactory to the General Manager, Shelter Support and Housing Administration and Deputy City Manager and Chief Financial Officer on the use of any savings from the education portion of property taxes through the property tax exemption recommended by this report towards maintaining TCHC's housing stock in a state of good repair.
7. City Council grant authority for the introduction of the necessary bills to give effect to these recommendations.

City Council Decision
City Council on October 24 and 25, 2011, adopted the following:
1. City Council authorize the Treasurer and other appropriate staff to pursue an investigation into a possible merger of the City's five Pre-OMERS pension plans with the OMERS plan, including entering into necessary discussions with the Ministry of Finance, the Financial Services Commission of Ontario (FSCO), the respective administrators of the City's five Pre-OMERS Pension Plans and the OMERS Administration Corporation.
2. City Council request the Treasurer and other appropriate staff to investigate and evaluate the possibility of winding up the City's five (5) Pre-OMERS Pension Plans, including the distribution of surplus assets.
3. City Council authorize the Treasurer and other appropriate staff to retain such experts, including external legal counsel and actuaries, as may be necessary to assist in the assessment, evaluation and potential implementation of:
i. a merger of the City's five (5) Pre-OMERS Pension Plans into OMERS plan; and
ii. winding up of the City's five (5) Pre-OMERS Pension Plans,
subject to an upset cost limit of $0.850 million, to be funded through the Employee/Retiree Benefits Reserve Fund;
4. City Council approve the increase in the 2011 Non-Program Operating Budget for pension consulting by $0.850 million gross and $0 net, funded by the Employee/Retiree Benefits Reserve Fund.
5. City Council request the Treasurer to report back on recommended next steps once the investigation of the options is completed, and the regulations dealing with the mechanics of plan mergers are in place under the Pension Benefits Act.

3. City Council authorize each of the Chief Corporate Officer and the Director of Real Estate Services severally to accept the Offer to Purchase on behalf of the City.
4. City Council authorize the City Solicitor to complete the transaction on behalf of the City, including paying any necessary expenses, amending the closing, due diligence and other dates, and amending and waiving terms and conditions, on such terms as she considers reasonable.
5. City Council authorize the City to make or provide its consent as owner to any regulatory applications by Habitat and to grant licences for a term of up to six months from the date of execution of the Offer to Purchase, renewable for up to three additional months, for the purposes of entering onto the Property to carry out pre-development activities and that the Director of Real Estate Services, or his designate, be authorized to execute the applications, consents and licences.
6. City Council authorize and direct the City Solicitor to execute all documents and to complete all postponement and discharge transactions required to give effect to the City's vendor take back mortgage.

6. City Council request the Provincial Government, under the Endangered Species Act, 2007, the Fish and Wildlife Conservation Act, 1997, the Ontario Society for the Prevention of Cruelty to Animals, and the Environmental Protection Act, to provide various measures to protect shark species.
7. City Council request the Provincial Government to ban the possession, sale, and consumption of shark fin, shark fin food products and shark fin derivative products in the Province of Ontario.
8. City Council request other Greater Toronto Area municipal governments to give consideration to adopting similar legislation to prohibit the possession, sale and consumption of shark fin and shark fin food products.

City Council approve an amendment to Chapter 694, Signs, General, to adopt amendments to come into effect on January 1, 2012 respecting signs providing marketing or promotion for a commercial development or residential development, substantially in accordance with the administrative design features as set out in Appendix A to the report (August 17, 2011) from the Chief Building Official and Executive Director, Toronto Building.
2. City Council direct the Executive Director, Municipal Licensing and Standards to report to the Licensing and Standards Committee on amendments to Chapter 693, Article II, Temporary Signs, concerning temporary signs utilized in relation to the marketing, promotion or advertising of the construction, development, sale, rent or lease of premises or property, such report to include strategies for incorporating the provision of temporary public art that excludes third-party advertising of any kind, such as murals on construction hoarding, where appropriate, as an ameliorative measure in the public realm, at the sole cost of the applicant.
3. City Council authorize the City Solicitor to prepare the necessary Bills for introduction in Council to implement Council's decision, subject to such stylistic and technical changes to the draft bills as may be required.
4. City Council request the Chief Building Official and Executive Director, Toronto Building, to review the effectiveness of the implementation of the amendment to Chapter 694, Signs, and report to the Planning and Growth Management Committee, within two years, such review to consider:
a. improvements in the level of compliance with the provisions of the Chapter 694, including the rate of applications for permit;
b. the level of compliance with the requirements to either remove or renew new Development Signs after their expiry date; and
c. whether additional security should be required as a condition of permit issuance to ensure the effective removal of the signs after the expiry date of their permits.

a. a staging, waste management, safety, and traffic plan, to the satisfaction of the Deputy City Manager, Cluster B; and
b. the proponent of the "Ironman 5150 - 2012" event agreeing to take direction from the City on the amount and beneficiaries of the community contributions.
2. City Council request the General Manager, Transportation Services, to report to the Public Works and Infrastructure Committee on January 4, 2012 on the amount and beneficiaries of the community contributions.
3. City Council direct the General Managers of Economic Development and Culture, and Transportation Services, to report to Public Works and Infrastructure Committee on the outcomes and any concerns related to the 2012 event, if approved and completed, should the proponent apply for similar expressway closures in subsequent years.
4. City Council endorse a framework for assessing applications to close the F.G. Gardiner Expressway and Don Valley Parkway for the staging of private events, comprising the following considerations:
a. Expressway closures for the purpose of staging a private event generally not be contemplated, unless unique and exceptional circumstances can be demonstrated by the applicant, to the satisfaction of City Council, taking into account the below-noted provisions;
b. The General Manager of Economic Development and Culture clearly identify and endorse the positive aspects in terms of the event's potential for significant enhancement or community building effects on Toronto's economy, profile or image, including any significant charitable benefits and the number of participants or potential for growth of the event;
c. No expressway closures for an event be permitted during long weekends, Honda Indy, Caribbean Festival, Pride or Marathon weekends, or any other significant events as determined by the General Manager;
d. Closure for events cannot interfere with planned maintenance work on the expressways;
e. Closures only between the hours of 2:00 a.m. and 2:00 p.m., with Sunday mornings highly preferable;
f. Closures for Gardiner Expressway only be between the Humber River and the Don Valley Parkway;
g. Closures of the Don Valley Parkway only be between Gardiner Expressway and York Mills Road;
h. No scheduled closures of Lake Shore Boulevard, Victoria Park Avenue, Bayview Avenue, Don Mills Road, Leslie Street and The Queensway during an expressway closure for an event;
i. Application would be subject to all applicable regulations pertaining to street events set out in Municipal Code Chapter 743 – Streets and Sidewalks, Use of; and any other regulation, including proponent paying all costs incurred by the City as a result of the event;
j. In 2015, all closures of the City's expressways will have their dates reviewed and possibly rescheduled or cancelled due to potential conflicts with the dates of the Pan Am Games from July 10-26; and
k. City Council acknowledges that the annual Ride for Heart event satisfies these criteria, and its permits will continue to be processed through the usual process of staff seeking Council's authority to issue.

5. Prior to the registration of the condominium, the Owner be requested to consider upgraded noise mitigation measures for the units fronting onto Torbarrie Road, and the Local Councillor and the Director, Community Planning, Etobicoke York District be advised of the outcome of the consideration.

City Council Decision
City Council on October 24 and 25, 2011, adopted the following:
1. City Council amend the Toronto Official Plan for the lands at 1 and 2 Meadowglen Place substantially in accordance with the draft official plan amendment attached as Attachment No. 7 to the report (September 16, 2011) from the Director, Community Planning, Scarborough District.
2. City Council amend the Woburn Community Zoning By-law No. 9510, for the lands at 1 and 2 Meadowglen Place substantially in accordance with the draft zoning by-law amendment attached as Attachment No. 8 to the report (September 16, 2011) from the Director, Community Planning, Scarborough District, subject to amending Performance Standard 274 by adding the words “security gatehouse”, to read as follows:
“Block I:
274. No above-grade buildings or structures, except for stair cases, underground garage entrances, landscape decorative features, utilities and a security gatehouse are permitted within the lands identified as "Block I" as shown on Schedule "1"."
3. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft official plan amendment and the draft zoning by-law amendment as may be required.
4. Before introducing the necessary Bills to City Council for enactment, City Council require the owner to enter into an agreement pursuant to Section 37 of the Planning Act to the satisfaction of the Chief Planner and Executive Director, City Planning Division, and the City Solicitor, such agreement to be registered on title to the lands to secure the following facilities, services and matters:
a. The owner is to provide a financial contribution to the City of $800,000 to be used for improvements to the Centennial Community Centre, the installation of a splash pad at Greenbrae Park and improvements to Thompson Park. The financial contribution is to be paid as follows:
i. A cash contribution of $200,000 paid prior to the issuance of any building permits for Phase 1 to be used for the Gatineau Hydro Corridor restoration and re-naturalization along the bicycle path in the vicinity of the Markham Road/Brimorton Drive intersection and/or local boulevard tree planting improvements; and a cash contribution of $100,000 paid prior to the issuance of any building permits for Phase 1 to be used for the Scarborough Walk of Fame.
ii. A cash contribution of $400,000 paid prior to the issuance of any building permits for Phase 2 to the Gatineau Hydro Corridor Re-naturalization project in Ward 38 and/or for local park improvements.
iii. A cash contribution of $100,000 paid prior to the issuance of any building permits for Phase 3 for improvements to Thompson Park.
iv. Each instalment payment set out in i. to iii. above shall be indexed upwardly in accordance with the Statistics Canada Non-Residential Construction Price Index for Toronto, calculated from the date of execution of the Section 37 Agreement to the date of payment of the funds by the owner to the City.
b. The provision and maintenance on the site of not less than 146 new replacement rental dwelling units for a period of at least 20 years, comprising 41 three-bedroom dwelling units, 95 two-bedroom dwelling units, and 10 one-bedroom dwelling units, of which at least 141 dwelling units shall have affordable rents and the remaining 5 dwelling units shall have rents no higher than mid-range rents. The replacement rental dwelling units shall generally be of the same type and size as contained in the existing buildings on the subject site at the date of enactment of the zoning by-law amendment.
c. The owner shall provide tenant relocation assistance for tenants in the existing buildings in accordance with the detailed terms as set out in the draft zoning by-law amendment attached as Attachment No. 8 to this final report from City Planning dated September 16, 2011.
d. The owner shall prepare a construction mitigation and tenant communication strategy, prior to the issuance of the first building permit (including demolition and/or excavation permit) in each phase of the construction, to the satisfaction of the Chief Planner and Executive Director, City Planning Division, and shall implement the Strategy.
The following matters are also recommended to be secured in the Section 37 agreement:
e. The owner agrees that construction shall proceed in accordance with the development phasing plan attached as Attachment No. 9 to the report (September 16, 2011) from the Director, Community Planning, Scarborough District.
f. The owner shall prepare a construction management plan and neighbourhood communication strategy, prior to the issuance of the first building permit (including demolition and/or excavation permit), to the satisfaction of the Executive Director, Technical Services in consultation with the Chief Planner and Executive Director, City Planning Division.
g. Prior to the issuance of Phase 1 building permits, the owner agrees to design and construct the external road improvements as noted in the updated traffic impact assessment, prepared by BA Group Transportation Consultants and dated August 2011, all to the satisfaction of the General Manager, Transportation Services and the Executive Director, Technical Services, in consultation with the Toronto Transit Commission. These include modifying the existing pavement markings on Brimorton Drive to create an eastbound left turn lane at Meadowglen Place and completing the necessary roadway modifications required to extend the existing northbound right turn lane south of Ellesmere Road to proposed Street B.
h. Prior to the issuance of Phase 1 building permits the owner shall provide a certified cheque to the Toronto Transit Commission (TTC) for $75,000 for the installation of transit signal priority at three intersections in the vicinity of the site as noted in the memorandum of the Toronto Transit Commission dated August 17, 2011.
5. City Council approve a development charge credit against the Parks and Recreation component of development charges if the Owner agrees to design and install Above Base Park Improvements at the proposed park. The development charge credit shall be in an amount that is the lesser of the cost to the owner of designing and installing the Above Base Park Improvements, as approved by the General Manager of Parks, Forestry and Recreation, and the Parks and Recreation component of development charges payable for the development in accordance with the City's development charges by-law.
6. City Council approve the application to demolish the existing two apartment buildings that include 141 residential dwelling units located at 1 and 2 Meadowglen Place pursuant to Municipal Code Chapters 667 and 363 subject to the following conditions under Chapter 667 which provide for replacement of the rental housing units:
a. The owner shall provide and maintain 146 residential rental dwelling units, for a period of at least 20 years, comprising 41 three-bedroom dwelling units, 95 two-bedroom dwelling units, and 10 one-bedroom dwelling units, of which at least 141 dwelling units shall have affordable rents and the remaining 5 dwelling units shall have rents no higher than mid-range rents.
b. The owner shall provide tenant relocation assistance for tenants in the existing rental buildings, including the right for eligible tenants to return to a replacement rental unit, to the satisfaction of the Chief Planner and Executive Director, City Planning Division.
c. The owner shall obtain a building permit for the replacement rental building (Tower A) prior to obtaining the first building permit, other than for shoring and excavation, for the condominium building (Tower B).
d. The owner shall prepare a construction mitigation and tenant communication strategy prior to the issuance of the first building permit (including demolition and/or excavation permit) in each phase of the construction, to the satisfaction of the Chief Planner and Executive Director, City Planning Division, and shall implement the Strategy.
e. The owner shall enter into, and register on title, one or more Section 111 agreements to secure the conditions outlined in a. to d. above and as further detailed in the draft zoning by-law amendment (Attachment No. 8) to the final report from City Planning dated September 16, 2011, to the satisfaction of the Chief Planner and Executive Director, City Planning Division, and the City Solicitor.
f. The owner shall enter into and register, a Section 118 restriction under the Land Titles Act agreeing not to transfer or charge any part of the lands to the satisfaction of the City Solicitor, without the written consent of the Chief Planner and Executive Director, City Planning Division or his designate, to assist with securing the Section 111 agreement against future owners and encumbrancers of the lands.
7. City Council authorize the Chief Planner and Executive Director, City Planning Division, to issue a preliminary approval to the application under Municipal Code Chapter 667 for either of the existing rental housing buildings in any specific phase of the development after the latest of the following has occurred:
a. the satisfaction of the conditions in Part 6 above;
b. the official plan and zoning by-law amendments in Parts 1 and 2 above have come into full force and effect; and
c. the issuance of the site plan approval for the development by the Chief Planner and Executive Director, City Planning Division, or his designate, pursuant to Section 114 of the City of Toronto Act, 2006.
8. City Council authorize the Chief Building Official to issue a Section 111 permit under Municipal Code Chapter 667 after the Chief Planner and Executive Director, City Planning Division, has issued the preliminary approval in Part 7 above for either of the existing rental housing buildings in any specific phase of the development.
9. City Council authorize the Chief Building Official to issue a permit under Section 33 of the Planning Act for any of the rental housing buildings no earlier than issuance of the first building permit for the shoring and excavation of the replacement rental building (Tower A), as shown on Attachment No. 1 to the report (September 16, 2011) from the Director, Community Planning, Scarborough District, and for the second apartment building, no earlier than all of the units in Tower A are ready and available for occupancy, and after the Chief Planner and Executive Director, City Planning Division, has given the preliminary approval in Part 7 above, which permit may be included in the demolition permit for Chapter 667 under 363-11.1E of the Municipal Code, on condition that:
a. the owner complete a residential building on site no later than three (3) years from the date the permit is issued for demolition of the buildings; and
b. should the owner fail to complete the new building within the time specified in Condition No. 9a. above, the City Clerk shall be entitled to enter on the collector's roll, to be collected in a like manner as municipal taxes, the sum of twenty thousand dollars ($20,000) for each dwelling unit for which a demolition permit is issued, and that such sum shall, until payment, be a lien or charge upon the land for which the demolition permit is issued.
10. City Council authorize the appropriate City officials to take such actions as are necessary to implement Council's decision, including execution of the Section 37 and Section 111 agreements.
11. In accordance with the delegated approval under By-law 229-2000, as amended, City Council be advised that the Chief Planner and Executive Director, City Planning Division, intends to approve the draft plan of subdivision as generally illustrated on Attachment No. 2 to the report (September 16, 2011) from the Director, Community Planning, Scarborough District, subject to:
a. the conditions as generally listed in Attachment No. 10 to the report (September 16, 2011) from the Director, Community Planning, Scarborough District, as amended, by adding the following Condition 101:
“Car Share
101. Prior to the registration of the plan of subdivision, the Owner will endeavour to provide a car-share program within the development to the satisfaction of the Chief Planner and Executive Director, City Planning.”,
which except as otherwise noted must be fulfilled prior to the release of the plan of subdivision for registration;
b. any such revisions to the proposed subdivision plan or any such additional modified conditions as the Chief Planner and Executive Director, City Planning Division, may deem to be appropriate to address matters arising from the on-going technical review of this development; and
c. draft plan approval not being issued until the necessary zoning is in full force and effect.

City Council Decision
City Council on October 24 and 25, 2011, adopted the following:
1. City Council amend Zoning By-law 438-86, for the lands at 9-21 Grenville Street substantially in accordance with the draft Zoning By-law Amendment attached as Attachment No. 6, to the report dated September 15, 2011, from the Director of Community Planning, Toronto and East York District.
2. City Council authorize the City Solicitor, in consultation with the Chief Planner and Executive Director of City Planning, to make such stylistic and technical changes to the draft Zoning By-law Amendment as may be required to give effect to the intent of the recommendations in the report dated September 15, 2011, from the Director of Community Planning, Toronto and East York District.
3. Before introducing the necessary Bills, City Council require the owner receive approval from City Council under Section 34 of the Ontario Heritage Act.
4. Before introducing the necessary Bills to City Council for enactment, City Council require the owner of the lands at 9-21 Grenville Street to enter into an Agreement pursuant to Section 37 of the Planning Act, to be registered on title, to the satisfaction of the City Solicitor, to secure the following:
a. Prior to the issuance of the first above-grade permit, pay to the City the sum of $1,800,000 consisting of $930,000 towards Yonge Street streetscaping improvements, $500,000 towards the upgrade of St. Luke Lane and $350,000 towards widening the sidewalks on Grenville Street and Wood Street, $20,000 towards LOFT Community Services for building improvements.
b. Require that the cash amounts identified in a. above shall be indexed annually in accordance with the Non-Residential Construction Price Index for the Toronto CMA, reported quarterly by statistics Canada in Construction Price Statistics Publication No. 62-007-XPB, or its successor, calculated from the date of execution of the Section 37 Agreement to the date of submission of the funds by the owner to the City.
c. A public art contribution in accordance with the Percent for Public Art Program for a value not less than one percent of the gross construction cost.
The following matters are also recommended to be secured in the Section 37 Agreement as a legal convenience to support the development.
d. The owner shall pay for and construct any improvements to the municipal infrastructure in connection with the Functional Servicing Report, as reviewed and accepted by the Executive Director of Technical Services, should it be determined that improvements to such infrastructure are required to support the development.
e. The implementation of any wind mitigation measures required by the applicant’s wind study, satisfactory to the Chief Planner and Executive Director, City Planning Division, to be submitted as part of a revised application for Site Plan Approval.
f. Prior to final site plan approval the owner shall:
1. In the event that deeply buried archaeological remains are encountered on the property during construction activities, the Heritage Operations Unit of the Ministry of Tourism and Culture be notified immediately at (416) 314-7146 as well as the City of Toronto, Heritage Preservation Services Unit (416) 338-1096.
2. In the event that human remains are encountered during construction, the proponent should immediately contact both the Ministry of Tourism and Culture, and the Registrar or Deputy Registrar of Cemeteries at the Cemeteries Regulation Unit, Ministry of Government Services, (416) 326-8393.
3. Provide and maintain an irrigation system, at the applicant’s expense, for proposed trees within the public road allowances including an automatic timer, designed to be water efficient by a Certified Landscape Irrigation Auditor (CLIA) and constructed with a back flow preventer to the satisfaction of the Executive Director, Technical Services Division, and requirement to maintain in good order and operation.
4. Enter into a Site Plan Agreement to the satisfaction of the Chief Planner and Executive Director of City Planning, under Section 114 of the City of Toronto Act, 2006.
5. Submit a stormwater management report, a site servicing plan and site grading, drainage and landscape plans.
6. Provide plans that show continuous weather protection with a minimum depth of 3 metres along Grenville Street for newly constructed.
7. Convey to the City a 0.3 metre wide strip of land across the entire length of the property abutting St. Luke Lane.
8. The owner shall provide a minimum of ten percent (10%) of the residential units in the building having at least three bedrooms.
5. City Council authorize City officials to take all necessary steps, including the execution of agreements and documents, to give effect to Council's decision.

TE10.5 - Removal of a Designated Heritage Property Under the Ontario Heritage Act - 21 Grenville Street

City Council Decision
City Council on October 24 and 25, 2011, adopted the following:
1. City Council consent to the removal of the designated property at 21 Grenville Street under Section 34 of the Ontario Heritage Act in accordance with the Heritage Impact Assessment and Heritage Relocation Plan submitted by ERA Architects Inc. dated July 15, 2011, subject to the following terms and conditions:
a. Prior to the introduction of Bills in Council for the re-zoning of the subject property, the owner shall:
i. enter into and register a Heritage Easement Agreement with the City for the heritage property located at 21 Grenville Street to the satisfaction of the Manager of Heritage Preservation Services and the City Solicitor; and
ii. provide a detailed Conservation Plan, satisfactory to the Manager of Heritage Preservation Services, prepared by a qualified heritage consultant that:
- contains a detailed condition assessment of the heritage building;
- details the demolition of the rear addition, the proposed method of detaching the heritage building from 25 Grenville Street, detailed plans for the re-location of the building and the integration of the heritage building with the podium of the proposed new construction as well as the proposed exterior restoration of the building once the move has been completed;
- includes a detailed cost estimate with descriptions and specifications for the work for the purpose of an indexed Letter of Credit to be secured within the Heritage Easement Agreement; and
iii. agree that the above matters will be secured in the zoning by-law amendment and the section 37 agreement to be entered into pursuant to s.37 of the Planning Act in a manner satisfactory to the City Solicitor in consultation with the Manager of Heritage Preservation Services and as a legal convenience, such that all heritage requirements imposed by Council as part of any zoning approval are appropriately secured in the section 37 agreement.
b. Prior to Site Plan Approval, the owner shall prepare and provide the following to the satisfaction of the Manager, Heritage Preservation Services:
i. site plan drawings in accordance with the approved Conservation Plan;
ii. a detailed Landscape Plan that supports the architectural style of the heritage building including reference to materials and finishes;
iii. a Lighting Plan including building and site lighting;
iv. an Interpretation Plan including interpretive elements regarding the property's heritage values, site history and archaeological resources as may be applicable, an implementation schedule and a budget; and
v. a record of the as-found condition of the building including architectural drawings and photographs keyed to plans and elevations of all visible interiors and exteriors.
c. Prior to the issuance of any heritage permit for the proposal, including a heritage permit related to demolition, shoring, excavation and rebuilding of any building or structure on the subject property:
i. the owner shall have received final approval for the zoning amendment and final site plan approval; and
ii. the owner shall provide a Letter of Credit, in a form and an amount satisfactory to the Chief Planner and Executive Director, City Planning Division, to secure all work including the implementation of the approved Conservation Plan, Lighting Plan, Landscape Plan and Interpretation Plan.
d. Prior to the release of the Letter of Credit, the owner shall:
i. implement the Conservation Plan, Lighting Plan, Landscape Plan and Interpretation Plan subject to the review and approval of the Manager of Heritage Preservation Services; and
ii. provide a Letter of Substantial Completion signed by the project architect and heritage consultant to the satisfaction of the Manager, Heritage Preservation Services.
2. City Council grant authority for the execution of a Heritage Easement Agreement to secure heritage matters related to 21 Grenville Street under section 37 of the Ontario Heritage Act and authorize the City Solicitor to introduce any necessary bill in Council.

City Council Decision
City Council on October 24 and 25, 2011, adopted the following:
1. City Council amend Zoning By-law 438-86 for the lands at 545-565 Sherbourne Street substantially in accordance with the draft Zoning By-law Amendment attached as Attachment No. 7 to report dated September 13, 2011, from the Director of Community Planning, Toronto and East York District.
2. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment as may be required.
3. Before introducing the necessary Bills to City Council for enactment, City Council require the Owner to enter into an Agreement pursuant to Section 37 of the Planning Act, to be registered on title, to the satisfaction of the City Solicitor, to secure the following:
a. The community benefits recommended to be secured in the Section 37 Agreement is a financial contribution of $1,000,000 to be paid prior to the issuance of the first above-grade building permit for the development, with such amount to be indexed upwardly in accordance with the Statistics Canada Non-Residential Construction Price Index for Toronto, calculated from the date of the Section 37 Agreement to the date of payment and is to be paid as follows:
i. $900,000 for the construction of a community pool at the Wellesley Community Centre; and
ii. $100,000 for streetscape improvements on Bleecker Street or other public realm improvements as part of the future Community Improvement Plan for the St. James Town neighbourhood.
b. In lieu of a 1 percent Public Art contribution, provide an extension of the current lease with Art City in St. James Town, or other appropriate on-site space that is affordable, at a below-market rent rate of $1,000.00 per month plus applicable HST, for a period of 10 years effective March 1, 2012 and with the ability to expand the premises in order to accommodate the increasing enrolment of children and youth in the future at a comparable below-market rental rate. If Art City and the Owner are unable to come to an agreement, the Owner agrees that it will make a contribution equal to one percent (1%) of the Gross Construction Costs of the Development to the City in accordance with the Public Art program to the satisfaction of the Chief Planner.
If, at any time, Art City no longer requires the leased premises, the Owner shall pay to the City any remaining balance of the 1 percent Public Art contribution and the City shall use that money for the purpose of a public art or cultural plan for the area.
c. The following rental housing matters are also recommended to be secured in the Section 37 agreement to satisfy the Official Plan policies and support development:
i. Securing of 1,107 existing rental housing units, excluding those to be demolished for a period of 20 years.
ii. The provision and maintenance on the site of 11 new replacement rental housing units, in the new residential tower for a period of at least 20 years, comprising 7 one-bedroom units, 3 two-bedroom units and 1 three-bedroom unit which units shall generally be of the same type and size as the units proposed to be demolished and existing on the lot at the date of enactment of the by-law amendment, of which all shall have affordable rents, and tenant relocation assistance for tenants in the affected existing units in accordance with the terms as set forth in the draft by-law attached as Attachment 7 to the final zoning report from City Planning dated September 13, 2011.
iii. A Construction Mitigation and Tenant Communication Strategy which the owner shall prepare, prior to the issuance of the first building permit (including demolition and/or excavation permit), to the satisfaction of the Chief Planner and Executive Director, City Planning.
iv. Other needed improvements and renovations to the existing rental housing without pass through costs in rents to tenants, to the satisfaction of the Chief Planner and Executive Director, City Planning including improved security and access entry system throughout complex, better access and improvements to podium landscaped space, and programmed amenity rooms and amenity space.
4. Before introducing the necessary Bills to City Council for enactment, City Council require the applicant to enter into a Site Plan Agreement under Section 41(16) of the Planning Act and Section 114 of the City of Toronto Act to the satisfaction of the Chief Planner and Executive Director and the City Solicitor.
5. Before introducing the necessary Bills to City Council for enactment, City Council require the applicant to conduct testing by a qualified structural engineer, at the sole expense of the applicant, to verify the integrity of the underground garage under Earl Street, and to provide all necessary improvements and upgrades, at the sole expense of the applicant, to the satisfaction of the Executive Director, Development Engineering, Technical Services Division.
6. Before introducing the necessary Bills to City Council for enactment, City Council require the applicant to prepare a strata reference plan of survey to illustrate the land occupied by the existing podium and the underground parking structure, at the sole expense of the applicant.
7. City Council approve the application to demolish the 10 existing residential units located at 555 and 565 Sherbourne Street, pursuant to Municipal Code Chapters 667 and 363, subject to the following conditions under Chapter 667 which provide for the replacement of rental housing:
a. the owner shall provide and maintain eleven (11) residential rental units on the subject site for a period of at least 20 years, comprising 7 one-bedroom units, 3 two-bedroom units and 1 three-bedroom unit, all of which shall have affordable rents;
b. the owner shall provide tenant relocation assistance including the right to return to a replacement rental unit in the new residential tower for the eligible tenants to the satisfaction of the Chief Planner and Executive Director, City Planning Division and as further detailed in the draft by-law attached as Attachment 7 to the final rezoning report from City Planning dated September 13, 2011;
c. the owner shall enter into and register one or more Section 111 Agreement(s) to secure the conditions outlined in a. and b. above and as described in the draft zoning by-law amendment (refer to Attachment 7: Draft Zoning By-law Amendment) to the satisfaction of the City Solicitor and the Chief Planner and Executive Director, City Planning Division; and
d. the owner shall register a Section 118 Restriction under the Land Titles Act (to the satisfaction of the City Solicitor) restricting the registration of a transfer or charge on title to those parts of the lands, comprising the 11 replacement rental units, without the written consent of the Chief Planner and Executive Director, City Planning Division or his designate, to assist with securing the Section 111 Agreement against future owners and encumbrances of the lands.
8. City Council authorize the Chief Planner and Executive Director, City Planning Division to issue preliminary approval to the application under Municipal Code Chapter 667 after the satisfaction of the conditions in Part 7 above, and after the Zoning By-law amendment referred to in Part 1 above, have come into full force and effect.
9. City Council authorize the Chief Building Official to issue a Section 111 permit under Municipal Code Chapter 667 after the Chief Planner and Executive Director, City Planning Division has given the preliminary approval referred to in Part 8 above.
10. City Council authorize the Chief Building Official to issue a permit under Section 33 of the Planning Act no earlier than issuance of the first building permit for the foundation of the development, and after the Chief Planner and Executive Director, City Planning Division has given the preliminary approval referred to in Part 8 above, which permit may be included in the demolition permit for Chapter 667 under 363-11.1, of the Municipal Code, on condition that:
a. the owner erect the residential tower on site no later than five (5) years from the day demolition of the existing rental units to be demolished has commenced; and
b should the owner fail to complete the new building within the time specified in condition a., the City Clerk shall be entitled to enter on the collector’s roll, to be collected in a like manner as municipal taxes, the sum of twenty thousand dollars ($20,000.00) for each dwelling unit for which a demolition permit is issued, and that each sum shall, until payment, be a lien or charge upon the land for which the demolition permit is issued.
11. City Council authorize the appropriate City officials to take such actions as are necessary to implement Council's decision, including execution of the Section 37 and Section 111 Agreements.

6. If the owner does not object to the amending of By-law 75-86, City Council authorize the City Solicitor to introduce the necessary bill in Council amending By-law 76-85 pursuant to Part IV, Section 30.1 of the Ontario Heritage Act.
7. Should the owner appeal the amending of By-law 75-86, City Council authorize the City Clerk to refer the proposed amendment to the Conservation Review Board for submission of a report to City Council for its final decision.
8. If the amending of By-law 75-86 is referred to the Conservation Review Board, City Council authorize the City Solicitor and appropriate staff to attend at the Conservation Review Board in support of the proposed amending of By-law 75-86.

1. City Council authorize the retention of the firm of Heenan Blaikie LLP to provide independent advice and representation from time to time to Members of Council in relation to any proceedings before the Information and Privacy Commissioner of Ontario concerning access to records held by a Member of Council; such retainer to be subject to the condition that the City Clerk and the City Solicitor confirm that the proceeding pertains to the individual interests of the Member of Council prior to counsel being retained to provide advice and representation.
2. City Council authorize the utilization of Account A70001, the Council General Expenses Account, for the payment of external counsel within the financial commitment limit authority for staff.
3. City Council direct the City Clerk to report yearly, in conjunction with the operating budget process, on the extent and costs of utilization of outside counsel by Members of Council.

City Council Decision
City Council on October 24 and 25, 2011, adopted the following:
1. City Council award a contract to GFL Environmental East Corporation, being the lowest bidder meeting specifications, for the collection of materials listed in RFQ 6033-11-3186 for a period of seven (7) years commencing August 7, 2012 to August 2, 2019 with an option to extend the resulting contract for (2) additional separate one (1) year period(s), if approved by the Public Works and Infrastructure Committee and City Council, for a grand total contract value of $186,405,881.65 including an estimated annual adjustment for CPI and net of HST recoveries.
2. City Council request the Acting General Manager, Solid Waste Management Services and the Director of Purchasing and Materials Management Division, to ensure any financial amendments to the contract be conditional on the approval of the Public Works and Infrastructure Committee and City Council.
3. City Council direct the Acting General Manager, Solid Waste Management Services, to ensure that all collection vehicles be required to post a large sign on the side and back of the truck that includes a complaint line telephone number and truck number for residents to lodge complaints when service is not to standard.
4. City Council direct the Acting General Manager, Solid Waste Management Services, to report to Council, in the first quarter of 2012, on the structure intended to be used to oversee the contract for the life of the contract and its associated costs and that specific performance targets be included in the monitoring plan, and that not meeting those targets be reported to the Public Works and Infrastructure Committee immediately. Performance targets should include (but not be limited to should staff identify additional measures):
i. Health and Safety violations in a set time;
ii. complaints received;
iii. diversion targets;
iv. accidents;
v. spills,
vi. incidents of contamination;
vii. contract violations;
viii. warnings issues; and
ix. fines/penalties imposed.
5. City Council direct the Acting General Manager, Solid Waste Management Services, to submit reports quarterly to the Public Works and Infrastructure Committee on the number of 3-1-1 complaints and number of open tickets regarding Solid Waste pick up in Districts 1, 2, 3 and 4.
6. City Council direct the Acting General Manager, Solid Waste Management Services, to submit reports annually to City Council, through the Public Works and Infrastructure Committee, on the following areas:
a. Customer service satisfaction rate;
b. Customer service complaints in each of the 4 districts with details on compliance with performance standards;
c. Fair treatment of workers in the Company (GFL Environmental East Corporation);
d. Diversion rate and tonnage by District;
e. Any and all "extras" beyond the contract paid to the contractor;
f. Any City costs to monitor and oversee the contract; and
g. Other areas the Acting General Manager feels that GFL should bring to the attention of Council.
7. City Council direct the Acting General Manager, Solid Waste Management Services, to develop criteria to evaluate the residential garbage collection east and west of Yonge Street, and report the results of this comparison to the Public Works and Infrastructure Committee at the conclusion of each year of the contract.
8. City Council refer the following motion by Councillor Janet Davis to the Acting General Manager, Solid Waste Management Services, for a report back to the Public Works and Infrastructure Committee whenever route schedules, collection times, and the annual collection calendar are affected by City staff initiatives or any changes to the districts to be serviced by GFL Environmental East Corporation and in all four collection districts across the City:

City Council on October 24 and 25, 2011, adopted the following:

2. The following instructions have been adopted by City Council and are now public:
1. 3. City Council authorize the City Solicitor and other appropriate City Officials to execute Minutes of Settlement and any related documentation including necessary agreements in a form satisfactory to the City Solicitor to give effect to Council's decision.

City Council direct the Board of Management of the Toronto Zoo as follows:
1. Toronto Zoo staff make the necessary arrangements with the Performing Animals Welfare Society (PAWS) sanctuary to physically transfer the 3 elephants, Iringa, Toka and Thika to its facility in California and to transfer legal ownership to PAWS as soon as arrangements can be made by PAWS to safely transport the elephants and permits can be obtained.
2. Toronto Zoo staff work with the PAWS sanctuary on transport and permit arrangements, with the PAWS sanctuary to have the primary responsibility for the safe and humane transport of the elephants to their facility in California, at their cost, while complying with all applicable laws and standards.
3. Parts 1 and 2 above be subject to the legal and financial commitments of PAWS and ZooCheck with respect to their contribution to the costs of the transfers being appropriately documented, to the satisfaction of the City Solicitor and the City Manager.
4. Toronto Zoo staff report to the Board of Management of the Toronto Zoo on the cost savings achieved in Zoo operations once the elephant transfer has been effected, and that the Board reduce its future operating budget by a corresponding amount.
