Public Notice - Bike Operation for Curb Lane Cafés Adjacent to Raised Cycle Tracks

Amendments to City of Toronto Chapter 886, Footpaths, Pedestrian Ways, Bicycle Paths, Bicycle Lanes and Cycle Tracks

 

Toronto City Council will be considering recommendations to pass a by-law to amend City of Toronto Municipal Code Chapter 886, Footpaths, Pedestrian Ways, Bicycle Paths, Bicycle lanes and Cycle Tracks to allow for the safe passage of pedestrians and bicycles where curb lane cafés are installed adjacent to a raised cycle track.

 

It is proposed that the by-law be adopted at the Council meeting to be held on June 26, 27 and 28, 2024 or at a subsequent meeting.

 

The report from the General Manager, Transportation Services, titled Cycling Network Plan: 2024 Cycling Infrastructure Installation - Third Quarter Update” has the following recommendations:

 

1. City Council amend City of Toronto Municipal Code Chapter 886, Footpaths, Pedestrian Ways, Bicycle Paths, Bicycle Lanes and Cycle Tracks as follows:

 

a. insert a new Section 886-14.2 to read as follows:

 

"§ 886-14.2 Bicycle operation at a curb lane café where pedestrians access a curb lane café area.

 

Where a person in charge of a bicycle or a large cargo power-assisted bicycle on a cycle track approaches a curb lane café permit area for pedestrian use in crossing between the sidewalk and the curb lane café permit area and an authorized sign is posted, the person on a bicycle or a large cargo power-assisted bicycle (1) shall stop before the area marked for pedestrian use, (2) shall yield to pedestrians crossing in the area marked for pedestrian use and (3) shall not proceed until all pedestrians have crossed the cycle track."

 

2. City Council authorize the City Solicitor to introduce the necessary Bills to give effect to City Council's decision and City Council authorize the City Solicitor to make any necessary clarifications, refinements, minor modifications, technical amendments, or By-law amendments as may be identified by the City Solicitor, in consultation with the General Manager, Transportation Services in order to give effect to Recommendation 1 above.

 

At its meeting to be held virtually and in-person on May 28, 2024, at 9:30 a.m. or as soon as possible thereafter, the Infrastructure and Environment Committee of Toronto City Council will hear in person, or by his or her counsel, agent or solicitor, any person who wishes to speak to the matter. Presentations will be limited to 5 minutes per person, unless the Committee decides otherwise.

 

Any comments received after the Infrastructure and Environment Committee meeting will be forwarded to Council.

 

The Infrastructure and Environment Committee will make its final recommendations on May 28, 2024, which will be forwarded to City Council at its meeting on June 26, 27 and 28, 2024.

 

While the staff report sets out proposed changes, the appropriate Committee and/or City Council may make amendments from the recommendations set out in the report.
