The First Meeting of City Council is a public meeting. On November 23, seating in the Council Chamber is reserved for invited guests and the public is invited to watch the meeting from a public viewing area in a committee room at Toronto City Hall. This meeting of City Council will be conducted with Members participating in person and remotely and the proceedings of City Council will be conducted publicly.

Committee Recommendations
The Striking Committee recommends that:
1. City Council approve the 2023 meeting schedule dates in Attachment 1 to the report (November 16, 2022) from the City Clerk and that the published schedule serve as notice for these meetings.
2. City Council amend the list of days of cultural or religious significance when Council does not schedule Council or committee meetings to include the National Day for Truth and Reconciliation, as set out in Attachment 2 to the report (November 16, 2022) from the City Clerk.
3. City Council request the City Clerk to distribute the approved schedule to the City's agencies and special purpose bodies with a request that they:
a. avoid scheduling meetings, whenever possible, that conflict with the approved schedule; and
b. avoid scheduling public meetings, forums, public consultations and large scale meetings on days of cultural or religious significance, as amended by Recommendation 2 above, and listed in Attachment 2 to the report (November 16, 2022) from the City Clerk.
4. City Council shorten the 30-day period that City Council may pass a resolution making an amendment to the Mayor's proposed budget to coincide with the completion of the Special City Council meeting scheduled on February 14, 2023.

Mayor Tory recommends that:
1. City Council authorize the extension of the hours of alcohol sales and service in the City of Toronto to begin at 8:00 a.m. between November 25 and December 18, 2022, to allow the public and local cafes and restaurants to enjoy and benefit from the 2022 FIFA World Cup Qatar.
2. City Council authorize the City Solicitor to introduce a by-law substantially as set out in Appendix 1 to this Letter.
Summary
Toronto’s restaurant industry and small businesses were severely impacted by COVID-19 and suffered under extended closures and significant restrictions. We must continue to find unique opportunities to ensure our establishments can come back stronger than ever and to support jobs.
The 2022 FIFA World Cup Qatar takes place between November 20, 2022, and December 18, 2022, in Qatar, an event that Torontonians look forward to with great enthusiasm and excitement. International events of this magnitude, which bring various cultures across Toronto to be passionately represented, offer a unique opportunity for us to continue to support small businesses in this diverse and dynamic City.
The time difference between Toronto and Qatar has resulted in many early morning games that will start at 8:00AM EST. As a result, residents will patronize local cafes and restaurants earlier than usual during this period. During this time, the ability to serve alcohol one hour earlier than the provincial standard would allow business owners to benefit even more from the celebrations across the City.
Under the Liquor License Act, the City may itself pass a by-law extending the hours of sale in all or part of the City by holders of licenses under the Act. To move forward with the timely implementation of the revised hours of alcohol sales and service hours, I am recommending City Council approve my recommendations.

Summary
On October 25, 2022 the Honourable Steve Clark, Minister of Municipal Affairs and Housing, introduced Bill 23, More Homes Built Faster Act, 2022 in the Ontario Legislature.
Bill 23 proposes extensive changes to the policy-led planning and development system under which municipalities in Ontario work. Details and preliminary analysis of the implications of Bill 23 were shared with the Mayor and City Councillors on November 3, 2022 (see Attachment 1).
Bill 23 passed 2nd Reading on October 31, 2022 and was referred to the Standing Committee on Heritage, Infrastructure and Cultural Policy (Standing Committee) for review. The Standing Committee has held two days of public hearings to date (November 8, 2022 in Markham and November 9, 2022 in Brampton), and is scheduled to hear two more on November 16 and 17, 2022 in Toronto.
The Chief Planner, along with supporting staff, is scheduled to depute to the Standing Committee at 1:00 pm on Thursday, November 17, 2022. A livestream of the public hearing will be made available on the Ontario Legislative Assembly website at this link:

Staff are also preparing written comments for submission to the Standing Committee.

The Chief Financial Officer and Treasurer recommends that:
1. City Council authorize the Mayor (or as an alternate to the Mayor, the Chair of the Budget Committee or the Deputy Mayor) and the Chief Financial Officer and Treasurer, during each of the years of the 2022 to 2026 Council term, including the remainder of 2022, to:
a. enter into agreements for the sale, or the issuance and sale, of debentures, and revenue bonds and for entering into bank loan agreements and conditional loan agreements with the Canada Infrastructure Bank, upon such terms and conditions, including price, as they deem expedient, for the purposes of borrowing money to obtain or provide long-term financing of any capital work, in an annual amount not to exceed $2.0 billion per year provided that such debt issue is in compliance with the Council approved debt guidelines as amended from time to time;
b. enter into any additional agreements necessary to provide for the management of interest rate risk, the management of currency risk or to minimize the costs or risks due to fluctuations in interest rates, all associated with the debentures, revenue bonds, or bank loan agreements upon terms satisfactory to them; and
c. to reopen an existing debenture issue if it is determined that the reopening will be advantageous to the City, depending upon capital market conditions.
2. City Council authorize the Chief Financial Officer and Treasurer, during each of the years of the 2022 to 2026 Council term, to:
a. temporarily borrow amounts that the City considers necessary to meet expenses of the City for the year and of prescribed amounts, whether or not they are expenses for the year, that the City requires in the year as set out in the applicable regulation under the City of Toronto Act, 2006 until such time as the taxes are collected and other revenues are received, provided the total amount so borrowed plus the principal amount of any outstanding temporary borrowings together with all accrued interest thereon at any time will not exceed $500 million per year, or;
b. temporarily borrow for capital works pending the issuance of debentures or entering into bank loans, in an amount not to exceed $500 million per year.
3. City Council amend Municipal Code Chapter 30, Debenture and other Borrowing, to reflect Recommendations 1 and 2 above, and authority be granted for the introduction of the necessary Bills in Council to give effect to the foregoing.
4. City Council amend the Financing of Capital Works Policy and Goals to reflect Recommendations 1 and 2 above.
Summary
This report requests the delegation of Council's authority to the Mayor (or as an alternate to the Mayor, the Chair of the Budget Committee or the Deputy Mayor) together with the Chief Financial Officer and Treasurer, in respect of the following long-term borrowing activities for the term of Council. This activity includes negotiating and entering into agreements for bank loans and entering into conditional loan agreement with the Canada Infrastructure Bank, and for the sale and issuance of debentures and revenue bonds all for the purpose of providing long-term financing for the City’s capital program, up to the recommended annual limits.
Following the City committing to issue the long-term debt through the delegated authority to enter into such a commitment being exercised by the Mayor (or Mayor's Alternate) and the Chief Financial Officer and Treasurer, the Debenture Committee must authorize it. The Committee is comprised of the Mayor, Chair of the Budget Committee, the City Manager and the Chief Financial Officer and Treasurer. Recognizing that such approvals for long-term debt must be obtained in a timely manner as required by capital market participants, City Council delegated authority to approve debt issuance and to adopt the necessary borrowing by-laws to the Debenture Committee.
In addition, the report requests the delegation of Council's authority to the Chief Financial Officer and Treasurer to negotiate and enter into agreements for bank loans and promissory notes not to exceed 365 days in respect of certain short-term borrowing activities on behalf of the City for the current term of Council. These activities include:
a. temporary borrowing primarily for operating expenses pending the receipt of annual taxes and other revenues during Council’s term, up to the recommended annual limits; and
b. temporary borrowing for approved capital works pending long-term financing, up to the recommended annual limits.
Since 2011, this authority has been delegated by Council for the duration of the Council term, within prescribed annual monetary limits. Prior to 2011, the authority was delegated annually. This report recommends the delegation previously authorized for 2022 continue for the remaining portion of 2022 which falls under this new Council term, allowing the City to issue debt prior to 2023. These measures are necessary to support the City’s efforts to access the capital markets in an efficient and effective manner so as to achieve its capital and operating requirements.

Summary
This report recommends that City Council refuse applications under Section 34 of the Ontario Heritage Act to demolish heritage structure(s) on the properties at 1196-1204 and 1206-1210 Yonge Street.
City Council has stated its intention to designate the subject properties under Part IV, Section 29 of the Ontario Heritage Act. A Notice of Intention to Designate was served on the property owners and the Ontario Heritage Trust, and was published in accordance with the Act.
The properties at 1196-1204 Yonge Street comprise a main street commercial block building constructed in 1889. The adjacent three properties at 1206-1210 Yonge Street contain 2-storey main street commercial row buildings constructed together in 1907-1908. They represent a unique architectural adaptation of existing late-19th century commercial block buildings by repositioning (lowering) the storefront level to align with the 1914-1916 regrading of this portion of Yonge Street to accommodate a new vehicular underpass/railway overpass across Yonge for the intersecting CPR rail line. These buildings are also considered to anchor the northwest quadrant of this historically significant intersection of Yonge Street and the railway crossing. Together they stand as surviving examples of the area's historic main street streetscape prior to the early-20th century introduction of transportation infrastructure and yields an understanding of the evolution of Yonge Street in Summerhill.
Applications under Section 34 of the Act have been submitted to demolish these buildings in order to allow for the construction of a 15 storey mixed-use building with commercial units at grade and residential units above. Under the Act, if City Council fails to make a decision on the demolition applications within 90 days of issuing a Notice of Receipt of the application, the application is deemed to be permitted under Section 34 of the Ontario Heritage Act. In this case the applicant must be notified of Council's decision by December 23, 2022.

Summary
This report recommends that City Council state its intention to designate the property at 415 Broadview Avenue under Part IV, Section 29 of the Ontario Heritage Act for its cultural heritage value.
Anchoring the northeast corner of Broadview Avenue and Simpson Avenue in the Riverdale neighbourhood and located directly across from the Don Jail, the property at 415 Broadview Avenue contains a Place of Worship completed in 1907 for the congregation of St. John's Presbyterian Church. Designed by the Glasgow School of Art-trained Scottish architect, Andrew Sharp, who built numerous early-20th century heritage churches across Toronto, is directly linked to the founding of the Scott Mission, which continues to provide important social outreach programs and services. Today St. John’s Presbyterian Church is valued as a local landmark.
The subject property at 415 Broadview Avenue was one of three properties on Broadview Avenue which were listed on the City of Toronto's Heritage Register in 2009 as part of a group associated with the historical development of properties on Broadview Avenue in the Riverdale neighbourhoods north and south of Gerrard Street East.
Staff have completed the Research and Evaluation Report for the property at 415 Broadview Avenue and determined that the property meets Ontario Regulation 9/06, the criteria prescribed for municipal designation under Part IV, Section 29 of the Ontario Heritage Act under all three categories of design, associative and contextual value. As such, the property is a significant built heritage resource.
In June 2019, the More Homes, More Choice Act, 2019 (Bill 108) received Royal Assent. Schedule 11 of this Act included amendments to the Ontario Heritage Act. The Bill 108 Amendments to the Ontario Heritage Act came into force on July 1, 2021, which included a shift in Part IV designations related to certain Planning Act applications. Section 29(1.2) of the Ontario Heritage Act now restricts City Council's ability to give notice of its intention to designate a property under the Act to within 90 days after the City Clerk gives notice of a complete application.
The owner provided a waiver to the City on February 4, 2022 that waived the time period in which City Council must make a decision in respect of the matter under the Ontario Heritage Act.
On January 20, 2022, a development application was submitted to the City seeking permission to construct a 10-storey building adding to, and modifying, the existing heritage church building onsite. The development scheme proposes 4,892.98 square metres of residential gross floor area (GFA), as well as 683 square metres of non-residential space to be allocated to the church congregation. (21 251348 STE 14 OZ). The application is currently under appeal to the Ontario Land Tribunal (OLT).
Designation enables City Council to review proposed alterations or demolitions to the property and enforce heritage property standards and maintenance.
